SSS Maternity Reimbursement

Hi Atty,
Nanganak po ako pang5th last April, 2011. Nagfile ng reimbursement ung company namin last Friday. Pero Denied due to 5th delivery not compensable daw. I asked our 3rd party Accountant kung anong dapat gawin kasi nagpapatulong ung HR namin.
as per our 3rd party accountant, dapat daw tanggapin ng SSS ung MAT2 kasi ni-rcv nila ung MAT1. sa MAT1 daw po kasi nakalagay na kung pang-ilang pregnancy. and sa online po 2 palang nake-claim kong benefit sa i have 2 pa daw.
as for my prenancy naman po, 1st pregnancy (miscarriage & employer did not notify sss and was not given any benefits), 2nd pregnancy (employer did not notify SSS and wala ring benefit), 3rd pregnancy (employer notified sss but ako ang nagpareimburse), 4-5 pregnancy (employer notified SSS and was given advanced maternity benefit).

How do i deal with this po? do i have to go to SSS branch office personally to talk to the approving officer?

i personally visited SSS Pasig to ask them of this problem.
1. Officer-in-charged told them that they cannot do anything about this problem because it is my 5th pregnancy. I told him my history. He told me na for example, i had 3 pregnancies and sa pang4th lang ako nagkatrabaho and un lang ung na-claim na sss maternity benefit, ung pang 5th na baby...di na pwedeng i-claim ng maternity benefit kasi pang 5th na.
2. Officer-in-charged told me that we have to check if makaka-claim ako for my 1st & 2nd baby. Since claiming daw is 10 years.

I also checked with my prev employer if tlagang Jan 2002 na kami start hinulugan ng SSS. After 2 days, nagpatawag sya ang gave me 2 check # na yun daw ung binayad nila sa akin kapalit ng SSS Maternity. Checked with my files and ung 1 nakita ko, pero with the other 1, di ko po nakita at di natandaan na binayaran nila ako. I asked him if may voucher sya para makahingi ako copy pero malay daw nya dahil 10 yrs ago na daw un. Bank won't give me feedback kasi need daw permission from my prev employer kung bibigyan nila ako ng feedback.
Present employer did not gave me my full 13th month pay because of this issue. They let me signed a contract last Friday, that i'm giving them permission to deduct 9K from my 13th month para pambayad dun sa advanced Maternity allowance and 30K balance payable for 6 months. (wala naman ako choice kundi i-sign)

Can a member apply for sickness benefit if she has been paid the maternity benefit?
No. A female member cannot claim for sickness benefit for a period of 60 days for normal delivery or miscarriage or 78 days for caesarean delivery within which she has been paid the maternity benefit. As a rule, no member can be entitled to two benefits for the same period.

tama po pagkakaintindi ko na di pwede 2 benefits at a time, since denied na po ako sa maternity, pwede kong i-file as sickness yung problem ko?

no harm in trying to claim sickness, but i will not be surprised if it's denied.

you really can't force sss to pay for the 5th pregnancy, but if you weren't paid for a previous pregnancy, then maybe you can claim that from them.

your current employer is correct to claim the advance payment from you.

I’m Kristine, 20yrs old, 7mos pregnant now, sadly a single mom and will give birth on MARCH 2012. This is my first baby. I was a member of SSS since May-Oct 2010. Pero hindi na ako nakakapaghulog now kasi yung previous job ko hindi nagkakaltas ng SSS.
Ask ko lang po kung pwede rin ba ako makakuha ng maternity benefits ng SSS? And san po ba ako included ngayon? sa employed padin po ba kahit wala na ako work?

you should go to the sss to inquire and file a complaint. while you are unemployed, you are considered self-employed.

Is it legal if the employer does not want to advance the maternity reimbursment? I had a miscarriage last April 19, 2012 and HR told me that I have to wait for 2-3 months since they don't advance the benefit which is Php30,000.00 because there are cases wherein after 2-3 months they will find out that it's denied. Would this be possible? Because from what I heard, it only takes 10days for the SSS to approve or deny such reimbursements. Please help.

that's not legal. i recommend you write a letter to your HR regarding their policy with a copy furnished to the sSS

if you did not receive your maternity benefit, then you can inquire at the sss. if they advanced it and did not reimburse, that's their problem

sss maternity benefits should be released in advance by your employer, not the SSS. the name should not be a problem as long as the birth certificate states that you are the mother.

Ask ko lang po kung papaano mag apply ng maternity leave ako po kasalukyang nasa abroad,bali second baby na po eto pero first time ko lang pong magaapply ng maternity leave...

Hindi po kasi ako makapagfile ng maternity reimbursement 4 months na simula ng nanganak ako dahil nawala po ng employer ko yung MAT1 form ko. Ano po ba ang gagawin ko para makapagreimburse ako? Sana po ay matulungan nyo po ako.

hi attorney, i gave birth last dec 2012 lang and until now hindi ko parin nakukuha yung maternity claim ko. i submitted all the documents needed before my delivery kasi alam ko nag-aadvance ang employer. pro when i asked hindi daw nila iaadvance, pagbalik ko na daw ng office ko makukuha yung check. is it legal? kahit ba under agency nasa law ba na dapat nila i-advance ang maternity benefit ko?

that's not legal. write a letter to the company so you have a paper trail. elevate it to the SSS. if they still don't comply, you can file a case at nlrc
