Claims against Condo Corp due to losses incurred in our Condo Unit due to Robbery

Hi,

Just want to ask if how we are going to file a case against our Condo Property Management Office for negligence. The incident happened almost 6 months ago and after a painstaking investigation the SOCO and police report results to negative. No culprit was pinned for the said crime.
The incident had happened a numerous times before on other tenants and unit owner. The Police report finds lack of security measures in the condominium. It’s only been 3 weeks since we’ve moved in by the time the incident happened and we want to make the Condo Management liable for the losses since we are paying them monthly dues which part of the payment for security services. We find them liable to negligence since we we’re not warned that unit robbery has been rampant in that condo. We were advised to install window grills which were the point of entry of the robbery only after the incident. Although we have installed a double lock in the door, the window is flawed and vulnerable for force entry.
After a few discussions with the PMO, the Security agency which PMO says are liable for the losses, denied liability. With this I would like to file a case with the PMO because I’m not in direct contract with the security agency. And issues of security agencies negligence is legally between PMO and Agency.
What kind of lawyer specializes on this and may I know what the steps for filling case. We’ve tried to settle this out of court but they are not responding to our claims. The total cost of lost items amounted to 107,000 pesos with items suchs as watches, psp, ipod and 1,500 cash of our maid. Just want to know how the process of filling cases like this is.

at first blush, i would not think your case has merit. the PMO is required to provide security, and if they did that, then it has fulfilled its duty. they cannot be held as absolute guarantors of your security.

on the other hand, i've seen other unlikely cases which came out victorious. you will need a litigator
