One of our regular employees had not been reporting for work since Aug. 15 with no advice to us. We learned yesterday from her brother that the employee is already working overseas since the 15h of August. The brother gave us a signed resignation letter of the said employee effective Sept. 22. 2011. The employee observed the 30-day notice rule but that's immaterial since obviously he has no intention of reporting back to work. The brother turned over to us company materials which were issued to the employee such as CDs and a number of working files.

What can we charge to this employee? Can we disapprove the resignation and proceed to terminate the employee's services due to abandonment of work or AWOL?

Please advise. Thanks!

what's the point for retribution?

if you do that, make sure your termination is by the book, complete with notices. you can also file a case for damages at the court.
