Ask ko lang po yung tungkol sa katrabaho ko, sinasabi nya na napahiya sya sa meeting kaya sya umuwi na sa bahay nila na kahit pinapabalik sya sa job ng OIC ay umuwi pa din sya. Is it abandonment of work? saka pano po procedure sa termination kung abandonment nga.

yes it is abandonment. procedure make NTE and report back to work letter, send via registered mail. failure to show up after allotted time send a notice of termination.

Kung umuwi lang ng bahay e 'UNDERTIME' or possible Insubordination lang ito. Kung hindi na pumasok sa mga susunod na araw e pwedeng Job Abandonment.

Based sa kwento mo, hindi automatic na Job Abandonment agad ito.

for it to be job abandonment, there must be reasonable assumption that the employee no longer intends to go back to work.

on the next day po di sya pumasok after po nun pumasok na po sya may intention po na pumasok. na badtrip lang talaga sa supervisor nya so i think insubordination na po kaso tama po ba? the demand explanation letter will be serve bukas dahil day off nya ngayon.

pwede po ba mag counter ang employee ng Constructive dismissal? dahil na rin sa pagpapahiya ng supervisor nya sa kanya ng maraming beses na daw po?

he can always claim constructive dismissal, pero he must present proof and yung NLRC mag dedecide kung constructive dismissal nga yan.

anu po ba ang pwd ikaso sa ka live ko ng 12yrs at meron kme 2 n anak.. lumayas po sya at s palagay ko po eh sumama sa ibag lalake at nkukuha po aq ng full conversation nila sa fb about sa gngwa nila..
