good day po.

bago po ako dito nais ko po sana humingi ng legal advise, me subpoena po na issue sa akin ng dati kong asawa at naka saad sa subpoena na kailangan ko pumunta dun sa prosecutor kaya lang po OFW po ako at andito pa po ako sa ibang bansa.

1.ano po ang dapat kong gawin para di ako mabigyan ng warrant of arest? 2. pano po ako maka pag conter afidavit sa kanya kasi po andito ako sa labas? napag usapan namin ng dati kong asawa na mag bibigay ako ng 100dollar amonth for the finacial support kaya lang po nag file parin siya ng complain at na issue nga yung subpoena.

have you been regularly sending support? do you have proof of these remittances?

what you can do is prepare a counter affidavit and have it notarized at the philippine embassy then send that to the prosecutor.

meanwhile have a representative inform the prosecutor of your plan and ask for time to prepare and send your counter affidavit.

na putol nga po ang padala ko atty since debember 2011 hanggang dun lang ang proof of remitance ko.pahirap din po kasi magpadala dito sa africa kadalasan tao ang pinapadalhan namin pag me uuwi.

atty hanggang august 1 and 8 2011 ang subpoena ko ang problema ko po wala pong embassy dito samin or consul man lang.

na tanggap po ng agency ko yung subpoena at pinadala sakin true email attorney.
puwede po ba attorney dun sa agency ko din ipadala ang counter affidavit ko?
at puwede po ba jan ako sa pinas magpagawa ng counter affidavit ko?

that doesn't sound good because you haven't sent support for 7 months. my suggestion would be to have it notarized before an african lawyer because that's as close to compliance to the rules that you can do.
