defense against RA9262

Good day, Im trying my luck to get answers ang help here, my step mother filed RA9262 against my father, they live in the same house and has children,the case is still in fiscal office and my father already received subpoena, my step mother lied on her sworn affidavit and my halfsiblings are willing to testify against her. My father and I already consulted with a lawyer and he strongly suggested for my father to have a lawyer even if it is still in the fiscal office, as much as possible we are trying to avoid expenses because there might be a possiblity that it will all end up in settlement, we wantex to sit and talk with her so that they can settle their indifferences without going to court but she is defermined to see my father in court. As per the lawyer if we wait for the case to go up in trial PPO may be filed by my step mother which worries. Thank you in advance.

if the plaintiff really wanted on court actions, bypassing out of court settlements, she can do that,
invoking, she don't want and no faith it will be resolved that way.

After marecieve ng father ko ang subpoena, humiwalay na ng room ang father ko, hindi na nila makausap ng maayos ung stepmom ko kahit na anong pakiusap ng mga anak nila na ihinto na kaso ayaw nya pa rin. Ang duda ng mga halfsiblings ko ay baka di na sane ung stepmom ko. ang advice din ng lawyer sa amin ay magfile na rin ng guardianship for incompetent kasi nahihirapan ng sila sa laging pangaaway ng stepmom ko sa father ko. may history kasi ng alzhemiers ang family ng stepmom ko.

im not sure pero excluded ata RA9262 sa article 151. Our plan is to attend the first hearing without laywyer and see what happens. Then maybe pikitmata na lang magbayad ng 50k acceptance fee+5k/apperance. Medyo nagwoworry lang kami kasi mas madalas panigan ang babae kapag ang case eh Ra9262
