Hi..my Name is Shaina, working in a shipping agency for 9 years. Last year,me and my office mates were transferred under payroll of our sister company but doing the same duties without being compensated from my previous company. My question, are we still entitled for a separation if we decided to resign?Pls help.

Under the labor law, separation is only given if the employment is severed by causes other than voluntary resignation. Smile

yes sir i know,pero we have been transferred sa under payroll ng ibang companya which happens to be the same owner. What is nagresign po ako ngayon, maaapektuhan po ba yung separation pay ko from previous kung saan ako dati nakapayroll? I understand po kasi na dapat bago ilipat ang isang empleyado sa ibang company kahit same owner dapat bayaran muna ang years of service nya sa dati. nagkataon lang po kasi na same nga po ang owner ng 2 company. pls help po kasi marami po kaming ganito dito sa work ko. thank you po.
