Hi!
This is Theresa, ask ko lng kng dapat ba na bigyan ng separation pay ang mga employee's once na nag-close ang company (hindi bankrupt ang company)just to change name.

were there new articles of incorporation filed by the new company or they just amended the old articles to change the name?

hi po..ask ko lang po if entitled yung brother ko sa separation pay..8 years no po sya sa company, then ngclose po yung company nila, sa cafeteria po sila..yung pumalit sa dating employer, inabsorb yung mga kuya ko pro as new employees na sila, 6 month contract lang sign nila, di regular..sabi nung dating employer, pwede daw sya di mgbigay ng separation kc di daw naman nawalan ng trabaho kasi nga po inabsorb sila nung pumalit sa kanya..tama po ba to? or dapat my separation pay kami sa dati naming employer?? ano po computation nun?? salamat po

IMO, he is entitled to separation pay. he can file a complaint at nlrc.
