Good day! Tanong ko lang po:
1. Pwede po bang magfile ng judicial separation of property kahit wala pang legal separation?

2. Kapag nagfile po ba ng legal separation at nai-grant ito ng korte, pwede po bang magkaroon ng kanya-kanyang partner ang dating mag-asawa?

1. Yup pwede because of different causes of action.

2. Nope, because in the eyes of law, they are still considered as husband and wife, separated lang sila sa bread and board, which means, hiwalay lang sila matulog, hiwalay kumain, hiwalay manirahan BUT they are still married to each other. So, they are prohibited to enter into another marriage.
