Pwede lang sila humingi ng danyos sa iyo kung gumastos sila para sa employment mo (cost of training/s, fares/bookings, etc). Lahat ng ito ay pwede nilang bawiin sayo. Pro kung wala naman silang nagastos para sa iyo e kahit humingi sila ng isang milyon e ni piso e hindi sila mabibigyan.

File a resignation letter and make sure it is received (approved or not). Have a copy of such letter for future use.



wala naman silang nagastos except sa sweldo na binibigay nila sa akin. Im just wondering bakit pinayagan ang mga kabatch ko na mag immediate resignation without having any threats. tapos nung ako na ang nagresign eh biglang my mga threats

Been reading some posts. And I noticed that some of the employees nowadays matigas ang bungo. As an HR, these are the type of employees na mahirap kausap. For the clarification of some people here.

**Immediate resignation
-Yes there is such process. However, the mandated one is 30 days. If you are in good terms with your respective boss or immediate superior, you can do it 15 days or kung gusto mo kinabukasan agad (if you don't have any pending accountabilities and allowed ka ng boss/mgt.)

Comment? Have respect. The company accepted you. They are going to pay you for every second you rendered during your stay with them. The reason why all companies are asking for 30 days is because:

1. To properly identify your pending accountabilities.
2. To look for another applicant suitable for your position.
3. To avoid disruption to the operations.

This is the common problem among employees. MATIGAS ANG MUKA. Everything can be done according to plan. IF you want to resign dahil di mo na masikmura ung muka ng boss mo, tell him/her ahead of time so that the operation will not suffer. Hindi yung naisipan mo mag resign ngayong gabe bukas ng umaga gusto mo agad agad.

So required ang 30 days kahit anong klaseng employee ka pa, kahit probationary pa lang? Kahit casual or contractual? Hindi kasi malinaw sa labor code yung 30 days, it did not state na all kinds of employees or those that are regular employees.

Kung regular ka given naman na kailangan talaga yung 30 days unless papayag yung company.

Sa tingin ko (opinion ko lang )unfair yung 30 days notice if hindi ka regular employee. If probationary ka, the company can terminate you any time( sa pagkaka-alam ko).So dapat pag probationary ka, pwede ka rin mag immediate or kahit 2 week notice lang.

Also ano po yung mga kasama sa "damages" na pwedeng hingiin sa iyo? Does that include yung bayad nila sa headhunter na nagrefer sa iyo? Lets say wala naman silang ginastos sa iyo bukod sa sahod mo at ito ngang finder's fee.

Malinaw ang LC na sakop ang lahat ng uri ng empleyado sa pagpapatupad ng Art 285 tungkol sa pag-resign na may abiso ng 30 araw.

I'm planning also to resign, willing sa 30 days if asked and comply for the clearances. Pero what if si company is ayaw naman ako paalisin? hanap ng butas or whatever reasons they will make, (me history na kase si company ng ganito at until now ginagawa sa mga nagreresign), hindi papayagan mag clearance at hihngan ng kung ano2. Di po ba karapatan naman ng empleyado na mag resign anytime, in our case kase si company hindi ni reremit yung SSS,Philhealth,Pag-Ibig at loans namin, and now nag aabot na ang pagkadelay ng sahod...sa pamiyadong tao po at ito lang inaasahan ng pahkukunan wala po magagwa kung di humanap ng mas matatag na kumpanya at inuuna ang kapakanan ng mga empleyado...ano po kaya ang pwede nyo i advice sa akin para na rin sa mga kasamahan ko din...Salamat po...God Bless..

Helllo po Atty. Good day po. Hingi lang po ako ng advice for my bro in law. He was resigned properly to his company as C.I.. He observed 1 month turn over period. Then mag 2 months na nang bumalik siya sa company to get his cash bond. At ang sabi ay wala pa 'yung clearance niya. And he found out na pinaho hold. Kasi po after he resigned, may mga na C.I. siya na naging delinquent at hindi masingil ng kolektor at saka lang nag validate yung officer po niya sa mga di masingil na clients at ayon daw sa pag iimbestiga ay may mga na C.I. daw po ang aking bayaw na walang business pero nabigyan. Ngayon po gumawa ng incident report ang officer na yun at ichinacharge po sa bayaw ko na bayaran yung unpaid balance ng mga nasabing clients amounting to 142,000 pesos. Ang siste pa po, siya lang po ang bukod tanging idinidiin na may responsibilidad at accountability sa nasabing mga accounts samantalang ang nag market na collector at branch manager na nag approve ng loan ay hindi po pinananagot. At hindi po ba pwedeng maging accountable ang nasabing officer samantalang pinahintulutan niyang makapag graceful exit yung tao na hindi man lang po vinalidate kung may mga problema ang bayaw ko po while he was observing 1 month turn over period? Is it proper na sumagot siya sa notice to explain while he is already not connected to the company? Kasi po wala na po siyang pagkakataon na maidepensa ang sarili niya sa Company dahil hindi na po siya connected sa Company at wala na siyang access sa mga tinarabaho po niya noon? Malaki din po ang chance na may manipulation sa ginawang pag iimbestiga nang nasabing officer.

Ano po ba ang pwede nilang mai advise po? Salamat po!

May duration ba yung employment contract mo? Other than that walang makakapilit sayo na magstay for more than 30 days. Be careful though, yung ibang employment contract may penalty provision if hindi mo matapos yung duration ng contract.

Yung 1 month after is normal. Medyo matagal yung 3 months pero wala kasing nakasulat sa labor code kung gano katagal. If makukuha naman talaga after 3 months i suggest you wait. It will take at least that long din if you a complaint.

You should still answer yung notice to explain. Yan na nga ang pagkakataon nya to defend himself and explain yung allegations sa kanya. Keep any documents na ipapadala or iibigay sa kanya. This can be later used for his defense

I was forced to resign by my manager because of my poor performance daw hello sa basis nyang 1 month! as in it's my first month plang doing that field work and it is my first time sa trabahong ganun. then something happened that affected my performance at work mga 1 1/2 mos ko na nun sa office. I was absent for about 3 days. . I informed him well that I was just sorting things out w regards to my personal problems. Pero ang nakuha kong reply sakanya is to be in the office para daw magdecided nako kung gusto ko ba talaga ituloy yung trabaho ko. FYI ni hndi ko naisip magresign. but this manager insisted that the best for the both of us kung magresign nalang ako. After we talked that day he even handed me the format ng resignation and even altered my resignation letter. sya pa nga nagprint. I was still not in my best self that time and wala akong nagawa kudi pumayag nalang. then He even requested that I SHOULD RENDER 30 days dahil daw BAYAD parin ako ng company. wth. I said yes but after about 2 weeks I realized I am wasting time and effort here. unang una hindi naman ako regular employee dito. second Finorce resign mo na nga ako gusto mo pakong pakinabangan? so on the 15th day of the rendering period I again submitted another resignation letter. effective immediately. I turned over the materials issued to me plus my company ID. wala naman din mga work na kailangan pang iiturn over. so after that hindi nako nagpakita sa office. come what after 1 week may dumating na sulat sa bahay from my manager na bumalik daw ako sa opisina at tapusin ang rendering kung hindi daw ay pwede nya akong idaan asa legal charges. I called up the HR. HR told me to email my manager na I could no longer render kasi may bago na kong work. sabi din ni HR the logical thing to do ni manager is to release my resignation (pwede naman na pla) so nag email ako sa manager after 3 days nagreply sya na iniinsist nya na BAYAD PARIN daw ako AT KAILANGAN KONG bumalik para gtapusin ang rendering. He even mentioned na Habitual absences ko and poor performance ko at binigyan daw nya ko ng maraming chance pero wala daw akong ginawa. ay wow.

1 1/2 mos going 2 mos lang po ako 3 weeks pa non halos trainings and seminars. kamusta naman yung basis nya ng poor performance.

the thing here is that wala nakong planong bumalik sa tanginang opisinang yon at baka mapatay ko sya. siguro makikipag communicate nalang ako kay HR kasi basically obvious na ginigipit nalang ako ng asshole kong boss.


Any advice on better things to do? please thank you

Hi I just wanted to know if what my previous employer did was just right. They did not give us our last salary (for the 7 worked days unpaid yet), 13th month pay and commissions because we filed an immediate resignation. We are actually willing to render 30 days if our employer did not shout at us and humiliate us in front of other employees. They said that there is no such thing as immediate resignation and that it is only for life threatening situations. It is stated in the contract that if we did not render 30 days, we need to pay for the shortfall (which they deducted in our supposedly final pay).

under the labor code, you can file for immediate resignation because of the circumstances you cited. But this doesn't invalidate the stipulation cited in your employment contract. So hindi ka na kelangan mag render under the labor code pero sa contract mo kelangan mo parin magbayad ng danyos dahil hindi ka nag render.

You can try to file a complaint sa NLRC tutal wala namang fee, sometimes kakatigan ka ng arbiter if maawa sayo.

But in my opinion tama yung ginawa ng employer which is to follow the contract

hi, i just wanted some assitance. Im working at a BPO company. I got sick last december and was not able to return back for follow up.

I was adviced that an RTWO letter was sent around January but up until now i havent recieved the mentioned letter yet. ( so from december till the date i posted this d pa ako nkakablik sa work and wala pa ako ntatanggap na RTWO)

Now i would like to immediately resign. My physical and most of all my emotional health is in decline. my recent relationship that lasted for 6 years( 2 years engaged ended on november) this has highly affected me. regarding physical health i was diagnosed with acute gastritis.
Can any1 give me the best advice on how i can immediately resign from the company. lilipat na din kasi ako ng tirahan different city na. any advice would be welcomed.

i would advise you to report for work. chances are pinadalhan ka ng rtwo and for one reason or another hindi mo natanggap. so chances are ni terminate ka na. this would be the best scenario since you dont have to render 30 days if you are terminated na.

just in case they did not terminate you, mag file ka na ng resignation. wag immediate isulat mo dun 30 days after ka mag file. then if di talaga pwede dahil sa medical condition get a note from your doctor. DO NOT use yung Emotional health reason. NOTE: there might be a chance pa report ka pa nila ulit kasi techinically you havent rendered parin

im very new to this, what is the best way para mag report ako sa work? basta lang ba ako susulpot then punta sa office. I was asking a team mate kasi kung kelan ko ba mtatanggap ung RTWO basta antayin ko lang daw. so got to work and speak with the coach/TL.

and if i am terminated my mkukuha parin ba akong back pay or wala na? 0 benifits ba un

simple question, can a probationary employee make a letter of resignation effective immediately? kasi ang pagkaka alam ko, ang 30-day/15-day notice is only applicable pag regular employee ka lang. at kahit ata di ka na humingi ng clearance sa kanila eh okay lang kung di mo naman tatapusin yung probationary period mo sa company. please enlighten me on this issue guys. thanks.

1. Yes, a proby employee can make a resignation letter which can be immediately effective.
2. NO, the 30 or 15 day notice is not only applicable to regular employees. The law is silent. As such, it applies to all types of employees.
3. Right ng empleyado ang magclearance kahit ano pa ang rason ng pagkaalis nya sa kumpanya. Kahit ito man ay resignation, end of contract, termination, etc.
4. Lahat ng empleyado ay may karapatang magresign pero ang hinihingi ng batas ay magrender ng at least 30-days. ANg rendering period ay hindi mandatory, ito ay recommendatory only. Pwede itong i-waive, paiklihin o patagalin pa. Pero hindi pwedeng pilitin ang isang empleyado na magtrabaho o magrender ng 30 days kung ayaw na niya.
5. Kung ayaw mag-render ng 30 days ang isang empleyado, siya ay pwedeng idemanda for 'damages'. And damages ay dapat actual at ito ay pwede lang isingil sa empleyado ng korte at hindi ng employer.

Looking for advice.

Nag start po ako mag work last april 17 monday 2017. Then nag resign po ako bigla ng may 10. Bali hindi pa po ako naka sahod ng kahit piso sa knila kahit ang pasahod nila is 10- 25. Nakipag usap naman po ako ng maayos sa employer ko bago ako umalis sa knila sa kadahilanan na 40pesos/hr at kung saan saan po ako naaasagin na branch. Tapos 5pm-12mn pa halos wala nako maiuuwi na sahod dahil dun. At gusto pa po ako pag bayarin ng 10,000 dahil daw sa pag reresign ko dahil nakalagay daw un sa contract. E wala naman sakin pinapirma na kahit ano ano po dapat gawin. Kasi hindi naman ako nirereplayan ng employer ko salamat po.

Yung 1 month after is normal.  Medyo matagal yung 3 months pero wala kasing nakasulat sa labor code kung gano katagal.  If makukuha naman talaga after 3 months i suggest you wait.  It will take at least that long din if you a complaint.

pano po kung wlang kontratang pinapirmahan?
