Kung may sulat galing sa doktor, pwede sanang mapaaga ang maternity leave mo o kaya leave without pay hanggang manganak ka.

Apat (4) lang ang dahilan kung bakit pwedeng mag-resign ng agad-agad:


1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

4. Other causes analogous to any of the foregoing.

Kung hindi ka naman ininsulto o binastos ng kumpanya o boss mo, o hindi ka naman pinahirapan sa trabaho, o hindi naman sila gumawa ng anumang krimen laban sa iyo (at mga parehong sitwasyon), kailangan mong magbigay ng tamang pasabi bago ka umalis.

Walang batas na nagbibigay ng benepisyo sa isang empleyadong kusang umalis sa kumpanya, pwera na lang kung nasa kontrata yun.

Lalong walang benepisyo (pwera sa nararapat na sweldo sa araw na pinasok, at 13th month at tax refund) sa mga hindi sumusunod sa patakaran tulad ng tamang pasabi o pagbibigay ng 30 day notice.

I have signed a 5-month contract in a construction company here in PH. I am thinking kung magrerenew pa ako ng contract after. According sa contract namin, we need to give 30-day notice for proper termination pag nag-resign. Ask ko lang: Kung di na ako magrerenew ng contract, do I need to inform my supervisor/HR (kanino sa dalawa?) a month before na di na ako magrerenew? Any tip?(P.S. This is my first job)

I tendered immediate resignation due to personal/family reasons which i discussed with my supervisors prior to filing. they also recommend immediate resignation based on my situation instead of incurring tardiness and absences while rendering the 30days. Can the HR deduct damages from my retirement pay? They also want to deduct the SSS sick leave benefit they gave me in which the SSS declined to reimburse due to late submission of reimbursement form (after a year). The HR said that i signed the reimbursement form late (on the date i processed my exit clearance). I told them i didnt know i have to sign anything. They should have informed me then while im still working, and they have the means to contact me thru mobile and email to notify me after my immediate resignation.

Am i liable for not knowing that i still have to sign the employers reimbursement form? Or its HR's fault? It was also not indicated in the sickness notification form i initially submitted.

If they approved your immediate resignation then you should not be liable for any damages.

Re SSS SL benefit - did you receive the benefit (advance) in full when the sickness notification form was filed? You should not be liable for that and they cannot deduct it from you since it is your benefit and they failed to complete their documentation.

Iba ang sickness notification form sa reimbursement, pero dapat pinapirma ka nila ng reimbursement form after nilang i-advance ang benefit. Kasalanan nila yan. They were negligent.

I am a supervisor currently working in a BPO company and has recently submitted my letter of resignation effective 5 days after as my employment for another company is about to start. While my immediate superior has signed the letter, I am worried that they might use it to get back at me in the future. During our initial conversation, the resignation was not supposed to take effect until June 27, however, due to the urgency of the position in my new company, they requested that I start on the 15th. Needless to say, it was a very difficult conversation with my superior that I had to consult with HR. She eventually signed my resignation letter but wasn't too happy about it.  Can they file any legal case because of my not rendering a 30-day notice?

In theory, Yes.

Did the supervisor and/or manager APPROVE the resignation? Or was it just signed as 'received' ?

30 days ang required ng batas.

Hello po.
I am currently working for more than 3 years na with a BPO company.
Balak ko po mag immediate resignation due to following reasons:
1. Ayaw nila ako bigyan ng increase kahit na promote ako as a Quality Analyst from agent position. (Note: Nag-ask ako sa kanila before starting the probationary training as QA pero di nila ako binigyan ng sagot and now sinasabi lang nila na pang - QA na daw sahod ko kaya wala na increase.)
2. Hindi lang scope ng QA ang ginagawa ko, pinag t train din nila ako ng mga agent which is trabaho dapat ng trainer.
3. Na promote ako na QA last September,2014 then nung Nov,2014 na lateral transfer ako as level 2 agent at binalik lang sa QA post ng March, 2015. (Note: Ang nangyaring lateral transfer ay "SHORT NOTICE" lang,,, ni hindi umabot ng 2 weeks, binigla lang kami.)
4. I have incidents of being treated unprofessionaly by the superiors like bullying in the office and being humiliated. (Kaya gusto ko narin mag resign)


Ask ko din po sana, until now kasi d parin pinapakita sakin contract for being promoted as QA, pag di po ako ng sign sa contract dahil d ako agree sa terms ano po mangyayari? May makukuha po ba ako "separation pay" if i refused to continue working with them?

And threathen me that they will sue me if I didnt render for 30 days. And I will pay if I didnt complete. The thing is I do not sign literally any contract from my company. Computer kase lahat kaya walang sign na naganap. And also many agents resign without these kinds of threat. I have friends from the same company na nagresign after two months from hire but without threats.

Pwede ka nilang idemanda kung hindi ka nag-render ng 30 days. Ang tanong, kapag humingi ba sila ng bayad e ibibigay kaagad? Pwede lang sila humingi ng danyos sa iyo kung gumastos sila para sa employment mo (cost of training/s, fares/bookings, etc). Lahat ng ito ay pwede nilang bawiin sayo. Pro kung wala naman silang nagastos para sa iyo e kahit humingi sila ng isang milyon e ni piso e hindi sila mabibigyan.

File a resignation letter and make sure it is received (approved or not). Have a copy of such letter for future use.

HI. I am to file my immediate resignation for the reason under Article 2856 of Phil Labor Code which is "b. Inhuman and unbearable treatment accorded the employee by the employer or his representative". My immediate and irrevocable resignation will take effect on January 13, 2016. I also have unclaimed monetary benefits from the Company where I am working. Prior to this, they are to terminate my employment for the reason that I have raised my unclaimed monetary benefits. I accept their offer of laying me off but eventually they decide that they cannot pay me so I opted to file an immediate resignation. My question is this, will it be possible to demand for immediate settlement of any monetary claims since I am being treated inhumanly as well?.. hoping you can give me answer for this

I got preventive suspension sa una kong company after 30days HR still doesnt have the notice of decision so I decided to apply in a different company but same bpo so nastart nako sa bago while waiting kasi kailangan ko gumalaw at gumawa ng pera then after another 30days may NOD dun sa unang company to cut it short pinagrereport nanila ako at I can go back to work na.. Now dalawa na sila pwede ko bang pagsabayin?

Kanina sabi mo lang tungkol sa trabaho sa dalawang kumpanya. Ngayon preventive suspension naman.

Ayun, baka matanggal ka sa una, at pwede rin sa pangalawa.

Hi!

With regards to Article 285 of Labor code which is "b. Inhuman and unbearable treatment accorded the employee by the employer or his representative;", this pertains to treatment to me by my employer as if I am a criminal and as a part time worker or no longer an employee of the Company. I do not have any access to any work that I usually does especially those concerning with the quality of work that are submitted to clients. Moreover, I also do not know anything about the Company at all since they ejected me in all the conversation. It all started last December 26, 2015. I understand that the company might be protecting confidential matters but there is neither no advice nor explanation given to me.

Prior to this, it all started when I raise my case of unsettled unclaimed monetary benefits which happens March 3, 2014 to August 19 2014 where I had no salary for the reason of suspension without valid reason. And from August 20, 2014 up to present where my allowance are not given even if I am reinstated.

We coordinated with DOLE and as per their advice they told us that the company is responsible to give to me my unclaimed monetary benefits even if I file a resignation.

Hoping to hear from you as as possible.

i am already clarified that upon resignation as an employee I need to render 30 days prior to the effective date.. i submitted a resignation jan 7 stating last day of employment of Feb 6, 2016, however the company i applied to requires me already to start january 25. so i requested that i need to be resigned eff jan 19. my problem is my supervisor and my operations manager doesnt like to even sign my immediate resignation as "receive" nor give me an acceptance letter though my supervisor agreed that she understood my situation. i am willing to offset my remaining leave balances and unpaid 2 weeks that i worked even though i am already releived from the 1 year contract bond which we signed before the training because ive been working 1 year and 5 months with the company. my reason of leaving the company was because of the very low salary i can no longer support my family i have 7 kids and none of them is working as they are all schooling. the company removed the easiest incentive that the employee can avail making the salary lower than before but of course i didnt mention the later in my resignation letter. Is my reason analogous to the situations stated under the labor code? another question is that can it be considered "Inhuman and unbearable treatment accorded the employee by the employer or his representative;" the habitual manda-ot, non-consideration of the medical cert on its eff date; and non-approval of vacation leave and enforcing leave without pay despite of the complete remaining payable leave balance? do i have the right to ask from them to sign my resignation at least received? thank you in advance atty...

wala naman silang nagastos except sa sweldo na binibigay nila sa akin. Im just wondering bakit pinayagan ang mga kabatch ko na mag immediate resignation without having any threats.
