Sir/Madam....i filed a case for my 3 daughters and daughter of my helper against our 2 neighbors for Maltreatment in relation to RA7610. We already had a preliminary investigation. Fortunately, during the investigation, the Fiscal got mad at the 2 accused because my youngest child cried. Our resolution is about to be released by next week, according to the Fiscal who handled our file. How sure am I that it will not be dismissed? If for instance, our case is approved, will there be a warrant for the 2 accused?

you'll have to wait and see. if the prosecutor found probable cause, and the court agrees then a warrant will be issued.

thanks for taking time to answer my inquiry. ang tagal na po namin nagaantay ng resolution, talagang ganun po ba katagal? from our last preliminary investigation, sabi nung fiscal hindi na ulit kami maghhearing, and he saw my youngest child so afraid and cried when she saw her offenders, pinalabas nya yung 2 accused and interviewed my daughter, sabi nung fiscal "grabe ang trauma nitong batang to" and then he decided hindi na kami maghearing ulit for the 2nd time. do you think we have a good chance na maiakyat yung case sa court? ganito po ba katagal gumawa ng resolution? almost a month na po kami nagiintay. thanks in advance atty.

mejo worried na nga ako, coz a relative of our offender told us, one of the accused is about to leave na for Singapore come September. hindi ko naman mapa-hold sa DOJ coz hihingi ng case number. wala na po ba ibang way to make her stay in the country? thanks po ulit

Atty, lumabas na po resolution in favor of my daughters. Mamaya po ir-raffle na kung saang branch mapupunta, pinapapunta kami ng OCC ng 2pm para mabigay samin details. Mabilis po ba ang pag issue ng warrant? buwan din ho ba ang aantayin namin? is it subject for approval pa ba yun? ang bail amount po is P80,000 per count.
yung sa hold departure po, matagal din po ba pagaantay namin dun?

warrant is normally issued in 2-4 weeks. when it is issued, you can help the police by pointing him out.

HDO is not automatic, you have to file a motion, and it depends if the court will grant it.

thanks po. but they voluntarily surrendered. they paid a percentage of the P80K. will have arraignment on Tuesday of next week.

atty. may natatalo po bang case pag bata ang involved? if the accused are found not guilty, what will happen to the complainants?

it all depends on the evidence. if they are not guilty, nothing will happen to the complainant.
