Good day,

i just want some advice regarding my problem

I sign a 3 month contract as a Trainee with my employer and i already finished the 3 month contract but we have a training bond that i will pay for 24 months, will it be still considered a breach of contract if i don't show up again(AWOL) to my company even if i have finished my 3 months contract that i have signed with them?

in my contract it stated there that i will be working with them as trainee for 3months and after that, you can choose to continue the 2 year contract or not. I decided not to continue but we have a Training bond that we are starting to pay after deployment. now will it still be considered as breach of contract?, My company did not gave me a copy of the contract.

i have 3 years contract in my company due to training worth 150 thousand. i decided to resign after two years in my company. there are previous case that resigning employees paid the remaining years or months. however in my case the HR alibi that there is a memo from Legal office that the company will be asking full payment upon resignation regardless of remaining years or months.

is the asking of full payment even though i already served 2 years in my company is fair and just? would the court merit this full payment?

is my company has the right to decline my resignation letter due to this contract?

what step should i do if the letter of resignation which also state my willingness to pay the remaining year will be paid is declined? i dont want to go awol, i will observe 30 days notice but how can i do this if they are uncooperative.

atty there is no breach clause in my contract. it simply says i have to stay for a period of 3 years even payment of full or remaining amount is not mentioned. that is why they argued that i have nothing to do but to complete 3 years or pay it in full which is unfair on my part. ty

you have the right to resign with the 30 day notice. at most, they can claim damages against you for their claim of breach. unfortunately, they will probably hold your salary and clearance documents.

i also believe that the the damage should be reduced, but that really depends on the circumstances.
