Immediate resignation due to health issue

Hi,

Just want to help my friend's case. He already submitted his resignation letter because he had immediate health issue. But due to process of our company, the resignation effects after 30 days. He's still working now to follow the process and he wanted to file for a leave on Sept 18 but the HR did'nt approve it. Is this illegal?

yes thats the right process. 30 days talaga para hindi sya maging liable for damages. if you're supposed medical problems really prevent you from working then try mo to submit a med cert after the 30 days, if mabait ang hr tatanggapin nila yun. if strict sila then they will ask you to work off the 30 days once you are no longer sick. no harm done unless mag work ka for someone else before working off your 30 days

oo napasok pa naman sya gawa nga ng 30 days pero bakit ayaw sya payagan mag leave eh karapatan pa din nya yun as an employee . Yun din issue nya ,yun sa leave nya.

Yes karapatan ng employee mag leave but karapatan din ng employer ang pumayag o hindi sa leave.

If nag file ng leave ang employee at pumayag ang employer - valid leave
If nag file ng leave ang employee at di pumayag ang employer at nag leave pa din ang employee - AWOL

Anong reason ba ang leave na file ng employee?

Hindi ba pang gigipit na lang un ng hr sakanya para makabuo sya ng 30 days?? Parang ang unfair naman kasi may health issue na nga tapos di pa payagan. Wala po sya nasabi bakit sya magfile ng leave eh Sad

wala kasing govt mandated sick leaves sa labor code. saka syempre hindi papayagan if hindi sinabi yung reason

Ang unfair pa din Sad Na halos magkandamatay na para sa work pero wala sila pakealam. Ako personally plan ko na din mag resign at same company lang kami nun friend ko, grabe kasi mga ugali nun mga ka workmate namin as in nakakasuka mga ugali. Actually dami na mga umalis at un iba dinala pa sa nlrc kasi di na tama mga ginagawa kahit un mga hr. Saklap bes.. hahaha.. Sorry sa term pero kasumpa sumpa po talaga.

Pero kasi may bond na 300k. Pero nilapit ko na yun kay Atty. Sison at sabi nya wag daw ako matakot dun. Hahaha.. Anyway maraming salamat po sa advise Smile
