hi atty,

i'm planning to resign immediately sa work ko po,since they deployed me to night shift naging sakitin na po ako. monnth of august till now pabalik balik nlng po ang pwedeng dumapong sakit sa akin. Ngpacheck up po ako sa doctor and she advised me na kylangan ko tlga ng maayos na pahinga at hnd na ako pwede sa pang gabing trabaho, sinabi ko rin po sa doktor na gusto ko nri mgresign dahil nahihirapan na ko tlga sa trabaho ko na puyat ang kalaban at lagi na akong nagkakasakit.

sinabihan ko na po ang supervisor ko about sa resignation ko at ayaw nya pumayag. pinakita nya rin po sa company nurse nmin ung medcert ko at sinabing hnd dw po valid ung reason ko for immediate which is chronic fatigue syndrome. now, my supervisor wants me to talk to my manager kung ppayagan ako mg immediate. hnd ko na tlga kaya pumasok dhil naapektuhan na ang work ko.

ano pa bo ang pwede kong sabhin sa manage pra payagan nila ako mg immediate resignation?

ANo yung nurse na yun??she does not understand chronic fatigue syndrome??tanggalan ng lisesnya yan..anyway..you can negotiate further with the management for dayshift work not on night shift..then of course company nurse and doctors are being paid to protect company's interest not of an employees..you can file a case to ECC..bring your concern to Bureau of Working conditions.

Immediate resignation is proportion to voluntary resignation, since your reason is due to your health conditions, your employer cannot compel you to continue your employment,. I think there legal department knows that .. They have the right to apply the Art. 284 of Labor Code. Disease as ground for termination..

Arresto Menor

Under Presidential Decree No. 442, Night shift workers INCLUDING CALL CENTER AGENTS are now allowed to request for morning shift and the company has to comply if conditions are met. I think the first condition of course is if your doctor recommends. Another condition is if your position has a similar or equivalent post in the morning shift. Kung wala, they have to transfer you to another position, but it has to be in the morning shift.

Maybe instead of resigning, i request (or force them) na ilipat ka sa pang umaga. Mahirap kasi maghanap ng trabaho.
