Sir,

Kasama po ba sa rental law na dapat ung pintura ng bahay eh ipagawa din ng umuupa pag alis? Ung may-ari kasi ng bahay lahat un pina pa charge niya. Di ba dapat hindi na kasama un? Lahat naman nadudumihan and naluluma eh. Hindi naman pwedeng hindi mahawakan at madikitan ng mga gamit ang dingding.

Kung hindi po nag babayad ng tax ang may-ari ng paupahan, may liability ba sila? ano po ang pwede kong gawin? hindi po sila nag biagy ng kahit anong official receipt sa mahigit dalawang taon kong pag-upa doon.

What would happen if the lessor did not follow this provision (Bank Deposit)?

And pintura ba ng bahay ay part of house components or accesories?

"SEC. 7. Rent and Requirement of Bank Deposit. – Rent shall be paid in advance within the first five (5) days of every current month or the beginning of the lease agreement unless the contract of lease provides for a later date of payment. The lessor cannot demand more than one (1) month advance rent. Neither can he/she demand more than two (2) months deposit which shall be kept in a bank under the lessor’s account name during the entire duration of the lease agreement. Any and all interest that shall accrue therein shall be returned to the lessee at the expiration of the lease contract. In the event however, that the lessee fails to settle rent, electric, telephone, water or such other utility bills or destroys any house components and accessories, the deposits and interests therein shall be forfeited in favor of the latter in the amount commensurate to the pecuniary damage done by the former."

Depende kasi sa usapan niyo yan kung kasama ang pagpapapintura nang bahay, kung napagusapan niyo na kayo ang magpapapintura, dapat niyo sundin yun, kasi yun ang agreement niyo. paghindi niyo nasunod, may possibility na magfile nang breach of contract against niyo or kung may deposit man kayo, maforfiet. YUN AY KUNG MAY USAPAN NGA KAYO SA PAGPAPAPINTURA NANG BAHAY, kasi kung walang usapan, ang sabi lang nang batas ay dapat isauli niyo ang property sa maayos na kalagayan subject to ordinary wear and tear, so kung faded ang pintura, ordinary wear and tear yan, di niyo obligastion, yan ay kung wala kayong usapan, PERO KUNG MAY USAPAN NA KAYO ANG MAGPAPAPINTURA, dapat kayo ang magpapintura. (CHECK MO YUN CONTRACT ABOUT SA PAGPAPAPINTURA, kasi sabi ko nga kung wala sa contract, di niyo na obligation yun kasi ordinary wear and tear yan at kontrata ang masusunod, yun written contract at hindi yun simpleng usapan lang na hindi nakasulat)

sa pagbabayad naman nang TAX, depende din yan kung kasama yan sa usapan niyo, kasi kung wala, edi ang may-ari nang bahay ang magbabayad.
