get the conjugal properties without the consent of the legal wife

i get some of the appliances from our conjugal house without the consent of my wife. lahat ng ownership pina lagay ko sa pangalan ko para di na makuha ng wife ko. ng nalaman ng wife ko ung nangyari she charge me theft. pwede po ba un? tama ba ung ginawa ko?

we both leave our conjugal house due to indifferences. i filed adultery case on her, kasi po nalaman ko sa co-worker ng wife ko na may boyfriend xa at nakakita po ng co-worker na un(caught in the act)that their having sex with the certain guy. na alam naman nong lalaki na married n ung babae. may laban kaya ako sa case ko?

yes, may laban ka sa case na theft, considering na kinuha mo yun property sa conjugal house niyo at you are claiming conjugal ownership sa property.

may court order na pla na null and void na pala ang marriage niyo?

Mr. tiago kinuha ko po un na wala pang araignment and pre-trail don sa case na pina file ko sa kanya. and im not claiming it as conjugal property namin. ang sinabi ko po ako ang bumili non (pero it was in the time of our marriage pagkabili) kaya pina name ko sakin. tama po ba un?

@Lair, may laban ka kasi mayroon dispute sa ownership na kinuha mong property at sabi mo nga nakapangalan pa sayo at that property was bought during the existence of your marriage, so hindi pasok sa theft ang ginawa mo. Ganito, i-explain mo lang maigi sa counter-affidavit mo na ang property na yun ay sayo, or at least co-owner ka nang property, so it is not a criminal act, it is more of a civil dispute.

ok po. may rights din po ba ung wife ko sa mga appliances n un?. may kinuha rin po akong gamit aside sa mga appliances pero di un nakapangalan sakin or shall we say wlang ownership basta ang alam ko gamit namin un sa bahay?

pinatawag po ako sa brgy pinadalhan ako ng summon sa dahilan nagreklamo ung wife ko don, out of 3 sessions, once (1) lang ako sumipot, dahil nga ayaw kung isauli lahat ng kinuha ko sa bahay namin.

sa ngaun may na endorsement na po binigay ung barangay sa wife ko.. may nakalagay po don sa sumon pala "failed to appear may contempt of court".. tama po pa un?.. ano stand ko ngaun dito?.. i receive all those summons, pero binabalewala ko lang..

Oo may possibiliity na magfile sayo ang barangay nang contempt of court. Attend ka lang sa Barangay Hearing, hindi naman ibig sabihin isasaoli mo ang appliances, baka pagayusin lang kayo kung ano anong property ang dapat saiyo at dapat sa ex mo.

mr. tiago, natapos na po ang barangay hearings, out of 3 sessions po, isa lang ang pinuntahan ko..

how would the barangay would file me contempt of court?

separate po ba ung sa kanila (barangay) na case?, kasi barrangay lupon na ung di ko siniputan ng dalawang beses.
