Arresto Menor

Atty., ako po ay nagpautang/invest sa isa naming kakilala to finance his Lending business, nag-issue po sya ng mga 12 PDC’s good for one year with 8% per month interest. Maayos naman ang pagbbayad sa umpisa kaya nahikayat ulit kaming mag-pautang sa kanya after a month kahit di pa tapos yung previous loan nya, and again nag-issue po ulit sya ng mga PDC’s at may kasamang notarized contract hanggang nasundan ulit ng pangatlo ito.

Last Oct 2010, di na po sya nakakabayad o walang pundo ang kanyang checking account hanggang nag-close na ito. Pero ginagawan namn daw nya ng paraan, at last December… nag request syang babaan ang interst, ako naman ay napapayag sa 2.5% per month na lng basta mabalik lng yung pera. Again nag-issue po sya ng new PDC’s sa bago nyang bank account para sa tatlong contracts namin na pinagsama at meron ulit bagong notarized contract para dito. Kaso two checks muna nabigay nya dahil naubusan na kasi daw sya dahil marami rin kaming mga nautangan nya ng ganito at inisyuhan nya daw lahat ng bagong checks yun iba.

Nag-due na po yung 2 PDC’s nya last January at February… at puro pangako na lng po natatanggap namin mula sa kanya. Yung first three contracts po namin na may mga PDC’s rin ay nasa amin pa rin at yung iba ay lagpas na ng 6 months. At wala syang linaw kong kailan makabayad dahil nalugi na daw business nya.

- Ano po dapat namin gawin, dahil ang taong ito ay taga-laguna at kami ay taga-cavite, pero nagpirmahan po kami ng papers dito sa Cavite.
- Mga magkano po abuting gastos para sa ganitong kaso.

Definitely, you can file a case for violation of BP 22 or the Bouncing Check Law.

The usual fee for a lawyer sometimes is contingent on the amount of checks subject of the case.

As a requisite for filing, you must first demand your debtor in writing to make good his obligation.

If no response at all, you can file the appropriate case before the Office of the Prosecutor at the place of the commission of the offense.

the challenge in BP22 cases is delivering the notice of dishonor and getting proof that it was personally received by the issuer of the check.

Maraming pong salamat sa reply nyo sir/s. I'll be depositing all his due checks next week, yung di pa na stale.

I think, yung Notice of Dishonor ay directly ipapadala sa akin ng bank after finding na close na yung account (tama po?).. I'll visit directly to his residence sa Laguna to deliver the notice, plan ko ring isabay ang demand letter from the lawyer.

Ask ko lng po... pwedi na po bang wife nya mag-receive ng notice nya? Kasi madalas na itong wala sa bahay dahil marami daw inaasikaso. Yung demand letter, sabi ay pwedi ring through registered mail, di ako sure if pwedi rin ito sa notice of dishonor.

Maraming salamt pong muli in advance.

when i say notice of dishonor, i refer to a letter which informs him that the checks were not honored by the bank. this is not the slip from the bank given to you.

the notice of dishonor can be included in the demand letter. if you send it via registered mail or have it received by his wife, that is good enough for a civil case. but for a criminal case of bp 22, you have to prove that he received the notice.
