How can I check if the deed of sale in 2008 is legal as my sister did this without the siblings knowledge . My mother died in 2009 , my father is still alive and denying signing any document as such.And why did she wait this long to process it..from 2008 to 2011..Now she is busted .( i hope )

Please help..Thank you

Update,,,it appears that the attorney, which name is on the Deed of Sale, has been de-registered,,at this point of time, is't not known when that happen, before or after the deed was signed, but one can only guess,,more work to be done.

Another question,,I have been told, that when a property is transferred from parents to one sibling, the other siblings must agree to and sign a document that the transfer has been agreed upon.If that is so, at what point of time does that document come into play in the transfer process. I have seen such a document at a friends place.Me and my two brothers have not signed any such document.

help please.

queens, when a parent sells a property to a child, no consent is required from the other children because the law assumes it is an actual sale. it will be up to the others to show it was just a simulated sale.

if the father did not sign it, then the sale is not valid. same if the mother's signature was forged.

I have asked my father if it is true that he sold the family home to my younger sister in 2008.. and he said NO..and he have no knowledge of doing so..And I beleive my Dad.. I beleive that this is another forgery that my sister did so she can have the house in her name..

Everything now is under investigation .. What will happen , if they can prove that the signatures of my parents in the deed of sale are not theirs. what should I do.. to my sister.

I forgot to say that my sister and i live overseas and I just found this out thru our provincial assesor who knows our family . By phone he asked me if it is true that my dad old our house to my sister, because the application is in his office. i asked him to stop it if he can .and he is investigating it now. the deed of sale is in a city and they contacted the municipal assesor to approve it ..then he went to the city to look at the document..he got all the details from the document but did not allow him to take a copy of it ..but we have the name of the attorney that signed it ..so.. someone working on that..do you need to pay to check with RD?

please help

have not yet obtained a copy of Deed,,,what would it show?
I will concentrate on the Deed of sale, with the attorney, whom I was told was de-registered, and does not show up in a search from a link on this site. I would assume that the deed of sale is not valid? I can provide his name here or email it to you.
Sadly, I think there are many more people out there in same situation.

the register of deeds would have the previous title and the document that was used to transfer the title, the deed of sale. you have to begin with that to see if anything was forged.

Sorry, my question was not meant to be direct related to my other post, but more a general question of how long it should take for a sale to be finalized,,1 month,,2 month,,,if not finalized within a certain timeframe, how long will the Deed of sale be valid for,,, any valid reason for not finalizing the sale once started.Hope this helps.

a deed of absolute sale does not lose its validity. what you probably refer to is the transfer of the title. that takes about 1-2 months.

If the attorney who's name is on the Deed of Sale was de-registered at the time, would that not make it invalid,,the attorney WAS de-registered at the time, that I know now.

the sale is still valid between the parties, but it can be argued that the document loses its presumption of validity.
