Good day Sir! I would like to seek your expert legal advise regarding the case that my former employer filed against me which is termination due to AWOL and abandonment of work. I was working as a call center agent for company X and I was fortunately accepted as an engineer in my present company Z. I advised my team manager about my incoming new work and he told me no problem. My new company Z asked me if I could start working immediately within 2 weeks instead of 30 days. I told them I need to ask company X. My manager at X said yes, it is okay not to follow the 30 day notice since it can be modified as long as you can show proof that you will start on the date that you intend to stop working for them. I gave my manager a copy of my contract with company Z and submitted to him my resignation letter as well which he accepted. I advised my new company Z that yes company X has accepted my resignation and I will start on the agreed date. But senior manager of X company disapproved of my resignation and even berated me. Since I started working for Z company, I got a letter from X company that I will be terminated. I don't think I should be treated as terminated for AWOL, tardiness and abandonment of work since I followed my team manager and he accepted my resignation. If he provided me the wrong information, I should not suffer for his wrong decision. What can I do? Do I stand a chance? Thank you very much.
