legal po ba ang magiging bentahan ng lupa kahit na hindi pumirma ang ISA sa mga tagapagmana?(buhay pa po yung isang ayaw pumirma).

it is legal, but the portion owned by the one who did not sign is not included in the sale. you only bought the portions of those who signed.

file an affidavit of adverse claim if they refuse to recognize the heir's ownership. file a notice of death also to both the bir and the registry of deeds.

nag file po ako ng adverse claim last week, pero di pinirmahan ng nasa RD.
para saan po yung pagpafile ng notice of death?
pwede po bang paalisin ng buyer yung nakatira sa lote na hindi pumirma sa bentahan?

has the property been transferred, if not send a letter to the buyer about your claim to make him a buyer in bad faith.
the notice of death is to prevent a transfer without the heirs.
the buyer will have to file a complaint at the bgy and at the mtc. he can not do it by himself.

alam po nung buyer na ganon ang sitwasyon,(na may ayaw pumirma at my hawak pang will.)
pero tinuloy parin po nya ang pagbili..dahil matagal npo niyang pinagiinteresan yung lupa para pagpatayuan ng business niya.
pwede po bang mamili yung kapatid na ayaw pumirma kung saan part ng lote ang gusto nya? (ex. sa harapan o sa likod o sa gitna.)

they can partition, but the co-owners will have to agree who will get which portion. no agreement, they will have to file a case for partition.

he cannot force the occupant to vacate by himself. it has to be done through a proper process through the courts.
