Hello good evening,

Meron akong friend and he asked for advice. Meron po kasi sila isa employee two weeks na di pumapasok tapos after two weeks pumasok tapos pumasok ulit tapos uuwi anytime na gusto nya. Tapos hindi na ulit pumasok ngayon ang sabi po humihingi ng pera. Subcon po sila and pakyaw po yun empleyado. Then nagtanong po friend ko sa abogado daw ang sabi padalhan dw po ng memo dapat yun nag absent. Ano po ba dapat gawin? Maraming salamat po.

kung subcon kayo at pakyawan ang trabaho.. pano makaka apekto yung tao sa pag a-absent niya? mag dagdag na lang kayo na tao. or kung gusto ninyo sundin ang payo ng atty ninyo.

Arresto Menor

Mabagal po kasi ang output ng negosyo kaso nag aabsent naman si employee ng wala pasabi. E balak po namin paalisin o tanggalin na si employee kaso di po namin alam kung ano po yun proper way? Saka Kapag po ba Subcon with not more than 40 employees tapos pakyaw po ang bayad sa tao kylngan po ba my 13th month pay?

kung gusto ninyo paalisin, gawin ninyo ang due proceess. notify employee of his violation (show cause memo or notice to explain), employee submits written explanation within 5 days, admin hearing and then termination notice. ask your lawyer to guide you on those steps.

yes kahit pakyawan kayo kailangan ninyo mag bayad ng 13th month pay.
