Pre-Termination of Bond Contract = Sum of Money

Good Day Attourney,

I need legal advice, the company i used to worked before (web development outsourcing company) file a case against me because of the pre-termination of bond contract which is 2 years and worth 100k. I signed the contract because at first there is no problem regarding the management but later i get unfair evaluations and uneven treatment. I resigned after 1 year and they refuses so I went awol. I submitted a resignation letter before i went awol and surrender all accounts and files.

Now I receive a letter containing a civil case sum of money against me.

my question is:

1. Can they really create a bond contract without giving trainings/seminars? (its not indicated in there contract though)

2. What will be the consequences if I ignore it? I dont have money nor any properties.

3. How can i delay the hearing date? can i postpone it?

4. what would be the best action to do right now? the hearing date is 8 days from now

6. Bonded Agreement
a. CONTRACT DURATION. as an employee hired for 2 years you are obliged to render the said number of years to the company, failure to comply will be subject to paying the company with the amount of Php 100,000.

let's go to this letter, who sent it? is it a summons or a demand letter? what hearing date is indicated? where will it be held?

did your resignation include 30 day notice?

- Its a summon letter from the clerk of the court in mandaluyong
- hearing date is on march 25, 2011 and will be held at metropolitan trial court in mandaluyong
- well no I didn't render the 30 day notice since they dump my resignation right after they receive it but i surrender all accounts and files.

i believe the company filed a small claims case against you.

you can be made liable for damages for non rendition of the 30 day notice. it is up to you whether you will appear. failure to do so will allow them to present their case by themselves and you will be deemed to have waived your right to defend yourself.
