Good evening po!
May ii inquire lang po sana ako. May habol po kaya sa employer ang isang employee kahit wala itong formal contract na pinirmahan?
May mga ebidensya nman po na nagtatrabaho sya sa dun.. May mga papeles at payroll na magpapatunay at magpapakita na pinapasahod sya ng employer.
Naospital po kasi sya.. Umabot ng 47k ang bayarin. Mahigit isang taon na po sya sa employer nya.. Di nman sya nagkulang sa pagpapaalala na ayusin ung mga benefits nya like pagibig, philhealth at sss. Since hindi naayos ang mga benefits nya.. Walang coverage na nakuha sa philhealth.. Nagpadala ang boss nya ng 17k pero nung nagbibilang na ang boss nya ng utang o vale nya.. Kasama ung 17k. May karapatan po ba syang maghabol ng damage sa boss nya?

Wala po kasi silang payslip.. Payroll lang po.. And wala tlaga silang kaltas ng benefits kasi in the first place di nga inayos ang mga benefits nya.

Pwede nya gamitin kahit anong document na makakapagpakita na sya talaga ay nagtrabaho sa kompanya. Attendance records or time cards, mga kopya ng official papers or memos na pareho sila ng boss nya na nakapirma, in-house training certificates na nakapirma yung boss nya or naka-indicate yung position nya sa kompanya, etc. You can think creatively here. Tapos ireport nyo sa SSS, etc. Since may kulong ang hindi pagreremit ng SSS contributions, mapepressure yung boss nya na ayusin yung mga mandatory benefits na dapat inayos nya na dati pa.
