Conditions about Contracts

I am employes for 8 months already, since the day that I've been hired my employer doesn't gave me a copy of contract thus on the day of my contract signing they only let me signed 1 copy of contract since its supposed to be 3 copies. One as my copy, 1 for the employer and 1 for the admin. But then, I have asked them last week about to give me a copy of my contract as my own copy pero ang sinabi nila wala pa daw nakaready. Pero nung binalikan ko ulit sila para tanungin kung merun na ba yung sariling kopya ko nga kontrata ang sinabi wala pa rin? I want to have my own copy because I am planning to resign. I just want to know the terms and conditions before I go. So that I know what are my rights.

I need an advice. So that i know what should I do.

I am in a 3 year contract in that school and I am under a probation period for a year. Mag iisang taon palang ako kaya patapos pa lang probation period ko sa pinagtatrabahuan ko. Ano po bang consequence pag umalis ako sa school ng nasa probation period pa lang ako at hindi pa ako regular employee?

make your request for a copy in writing; an email will do. make sure to finish the school year before resigning

That was my plan po to resign after this school year but I need to pass a resignation letter bago ako umalis kaya gusto ko ng copy ng contract kasi di ko po kabisado laman nun at para alam ko po ang gagawin ko. Mas may lamang po sila kasi sila may copy sila ng contract ako wala. I just want to be fair. Okay I'll do that po.

if they're refusing to give you a copy, saying you are resigning will force them to show you the contract if they have any objection

Pero paano po pag di talaga nila ako binigyan ng copy since right ko naman po na dapat may copy ako, ano pong gagawin ko? Pwede ko po ba silang ireklamo or something?

At tsaka if ever man po na humingi ako ong copy ng contract dapat po maibigay nila agad. Ilang beses na po akong nagpabalik balik para kumuha ng kopya pero wala pa din daw po. Di po kaya may problema sa kontrata kaya di po nila maibigay o maipakita man lang.

not really your right to get a copy, although DOLE usually finds it suspicious if they learn that the employer refuses to give you one. For next time, wag kang papayag na hindi ka bigyan ng copy during contract signing

next time, kunan mo na agad ng picture lahat naman may phone.

if they refuse to give you a copy after you let the know of your intention to resign then maybe there's nothing on it that they can use against you

nag reklamo po ang department leader namin sa akin nang immoral advances or lacivious acts dahil nag leave in po kami nang girlfriend ko. pinadala kasi kami sa ibang bansa at wala po yon sa contrata namin regading po sa accommodation namin. tapos pina aga po ang uwi ko dahil daw sa serious misconduct ko. napahiya po kami. pero sa investigasyon po ay wala ho kaming penalty. ano po ho ba pwedeng gawin ko po? pwede po ho ba akong mag resign?meron kasi akong binding contract. salamat.
