Good Day!

May I ask po regarding on the subject above, all legal action was done start from Brgy and she never attended at all, I've been trying to reach her but her number was changed. Been calling to her employer also but she's hiding and telling to operator that there were no name's "Kristine Isabel Canaya" working on that company, But I already confirm that she's working on that company aerosapce. I have no choice I ask the lawyer for the legal action and send her Demand Letter which is 5days is the leadtime to settle. What is the next action after the demand letter was not giving attention? She was not showed any interest that she is willing to pay. What would be the next legal action for this attorney? Please advise and thanks po

Arresto Menor

You will need a Barangay Certificate to File Action, and then submit your case to court. At that time you will furnish respondent with Affidavit. If the Affidavit is ignored you can ask the court for a judgement in your favour.
At the same time, bare in mind that if she does not have any assets that you can pursue then you will be wasting your time, and your money. No car, no land other than the house she lives in equals futile effort.

Yes meron na po akong certificate from brgy. And as per advise we need to send demand letter. We are done on it so the next is filling a case? I am so worried about the expenses because I am a solo parent and its not easy for me to waste money mostly out of the budget. Is there any institution who accepting free of charge when filling a case? I hope there is.

Filing a small claims case would still require some filing fees, though it would be minimal considering that the amounts being claimed are just "small".
