Hi,

I just want to confirm if this will be tagged as cyber identity theft. If someone used your name on a chat engine to send someone an information about the truth (third party relationship issue) and you did inform the person that the profile you are using is not you then deleted the account after. What charges will this person get if ever? That person did not use the account to get money or something else.

Your response is greatly appreciated.

The person used the name of the girlfriend of the guy involve. But after giving the information to the other guy, she deleted the account. What will happen to her?

Most likely nothing because it is very difficult to trace back an anonymous/fake account. Nevertheless, if the PNP or NBI are willing to find her, it can be done, and she can be prosecuted.

SEC. 28. Processing of Personal Information and Sensitive Personal Information for Unauthorized Purposes. – The processing of personal information for unauthorized purposes shall be penalized by imprisonment ranging from one (1) year and six (6) months to five (5) years and a fine of not less than Five hundred thousand pesos (Php500,000.00) but not more than One million pesos (Php1,000,000.00) shall be imposed on persons processing personal information for purposes not authorized by the data subject, or otherwise authorized under this Act or under existing laws.
