iS THE DEVELOPER LIABLE TO DEATH CLAIM DUE TO DELAY PROCESSING AT PAG IBIG

m My son purchase a house and lot to a developer thru Pai ibig Fund. He has already paid the equity when he died becuase of an accident. The developer said that he can not file an insurance claim because the loan take out was not yet process in Pag ibig Fund. My question is, can I obliged the developer to assume the the insurance claim because the delay was not my sons fault. The equity was fully paid several months ago before he died. He has also submitted all the requirements needed to the developer. Can anybody advice me on this issue, specially the legal aspect? Lawyers please reply!
