Hi Attorneys.

BPO agent ako. Halos 1 month na kaming nagoovertime na may pre-shift OT ng 2 hours daily at Rest Day OT naman either sabado o linggo, lahat yun MANDATORY. Bagong account yung handle namen, so yung mga trabaho nung pinalitan naming mga ahente, samin napunta. Kailangan naming magclose ng napakaraming cases. Sabi ng mga bosses, they conducted a research na kailangan ng 35 representatives para magawa yung ginagawa ng buon team namin. Ang team namin ay composed of 11 members lang at minsan umaabsent pa yung isa o dalawa.

So parang ang labas, bawat isa samin ay nagta-trabaho ng apat na tao dapat ang tumatrabaho, at dagdagan mo pa pag may umabsent saming isa o dalawa.

November 2 and 3, hindi ako nag pre-shift OT. So imbes na 7pm ako pumasok, 9pm ako pumasok. Nabigyan ako ng show cause memo dahil dun. Type A (Verbal Warning) lang naman.

Nakalagay na date sa pinirmahan kong "show cause" memo ay November 4, pero November 6 ko siya pinirmahan. Huli ko na nakita na Nov 4 pala nakalagay dun. Tsaka meron din akong pinirmahan na Mandatory OT form na included yung araw na November 2 and 3. So ang labas sabay kong napirmahan yung show cause memo ko tsaka yung Mandatory OT form noong November 6. Legal pa siguro yun kahit late ko na napirmahan, ano?

Ang concern lang namin ay kung legal ba yung 2 hours pre-shift OT at RD OT ng isang buwan at ongoing pa rin ngayon?

Lagi nilang sinasabe na matatapos na yung mga OT pagtapos ng 2 weeks, pero pagkatapos nun ieextend nanaman nila ng 2 weeks. Yung pinirmahan naming mandatory OT form, effective hanggang November 17.

Kung may susunod na mandatory OT form na papapirmahan samin, pwede ba akong hindi pumirma? Anong gagawin ko pag pinilit akon pumirma ng mga boss ko?

Kung mateterminate ako dahil dito, may laban ba ako?

yes lega yan. pwede naman mag OT habang buhay basta may ot pay.

nope basta tama ang bayad and bigyan ka nila ng hearing wala kang laban.

Maraming salamat po sa sagot. Pwede bang hindi ako pumirma sa mandatory OT form? Pano pag pinilit ako pumirma ng mga boss ko?

First regarding your mandatory OT, it falls under e section 10:

SECTION 10. Compulsory overtime work. — In any of the following cases, an employer may require any of his employees to work beyond eight (Cool hours a day, provided that the employee required to render overtime work is paid the additional compensation required by these regulations:

(a) When the country is at war or when any other national or local emergency has been declared by Congress or the Chief Executive;

(b) When overtime work is necessary to prevent loss of life or property, or in case of imminent danger to public safety due to actual or impending emergency in the locality caused by serious accident, fire, floods, typhoons, earthquake, epidemic or other disaster or calamities;

(c) When there is urgent work to be performed on machines, installations, or equipment, in order to avoid serious loss or damage to the employer or some other causes of similar nature;

(d) When the work is necessary to prevent loss or damage to perishable goods;

(e) When the completion or continuation of work started before the 8th hour is necessary to prevent serious obstruction or prejudice to the business or operations of the employer; or

(f) When overtime work is necessary to avail of favorable weather or environmental conditions where performance or quality of work is dependent thereon.

Consequences depends on what is stated in your code of conduct. The usual will be hampering operations, insubordination, etc. penalties also depends on gravity of the offense ranging from warnings to dismissal if done more than x times. Check your polices / code of conducts.
