hi, thank you for the free legal service you provide. I hope you can help me. here is my story

last Feb. 06 2017,i was hired as a trainee for CSR, the training period will last upto 3mos and for probationary 3months.According to my supervisor there will be evaluation which is an exam. after 3months i pass the training exam.my employer let me sign a contract stating that my regularization is aug 09, for me it was suppose to be aug 06 because it will mark my six month. On Aug. 09,my supervisor give me an exam which i answered. On August 10,The over all manager and my supervisor invited me outside office. Informed me that I did not pass the regularization. They all informed me that i failed to answers some emails and failed the exam. they also told me that there was a customer complaint .they did not invite me for a hearing about it,no coaching was done. i always hit more than the quota. Can we call this illegal dismissal? I already went to nlrc to complaint and we already no settlement was done, when i was about to go out in the room there lawyer asked me if i am asking for damages i said yes, the lawyer said we will also file damages, i was thinking if he meant that they will file damages if i lose the case? I appreciate if you can provide answers to my questions. thank you

they can also file for damages even if you dont lose the case. Did they tell you why they are filing for damages?

Your employer have the right to terminate your services as you're still on the probationary status which is basically your under observation. It is just that the process of termination is shady and you still have the right to make a complaint.
