I have a vital position in the Company for more than a decade. I was assigned in one of our prestigious clients as contractor with more than 150 workforce personnel. Last month I received an email from the Head of Project Contract notifying the General Manager of my company that I am temporarily relieved from my duties until further notice for committing a minor offense of failure to follow Client’s rules and procedures . I communicated with the GM and he verbally told me that he placed me under preventive suspension while my case is under investigation. I did not receive any official memo from the Company that I was placed under preventive suspension and relieved order from my post.. The document that I received was notice to explain for willful or unjustified refusal to abide my validly issued policies, directives, instructions, memoranda or notices related to work or behavior within client premises with corresponding 7 days suspension for first offense. Upon receipt of the NTE I submitted my explanation. I was advised by my Company that they will finish the investigation asap. Days and weeks have passed I did not receive any official communication either verbal or written memo from our HR for possible admin hearing. I personally reported to my GM every week to follow up my employment status and he said that he is taking a consideration to look for another assignment that fits my qualification and current salary. He offered a position however the salary and benefits is not that high compared on what I am receiving right now. Should I accept the new position my salary will decrease by 50%’. It is already more than a month that I have not received any official word from my Company about my employment status. Here’s my questions;
1. Is it legal that I was placed under preventive suspension without official signed document?
2. The Head of a Project Contract is not employed by the Company. He is the one who ordered a temporary suspension until further notice. Probably the Company took this as their basis to place me on preventive suspension. Is this legal?
2. Am I entitled for compensation in which the Company should pay my wages and other benefits during the extension of my preventive suspension?
3. If I accept the position does it mean that I am waving my right for salary downgrading thus the Company has no more obligations on wage deduction?
