Hello,

Good Day,

I received a notice from camella that my unit is now due for construction. However, They cannot build what was stated in the contract. please see email below

"We would like to discuss matters with you regarding your purchased unit at Camella Ellisande. As we are on duration of our pre-construction activities for your unit, our technical team has raised some changes regarding the measurements of your lot area as well as the house.

Due to changes in subdivision plans, there might be reduction on your existing lot area. From 70 sqm, new lot area will be 62.67 sqm (7.33 sqm difference). In this regard, we won’t be able to build the end unit house plan on the stated lot area. Thus, we might convert the floor plan to Inner Unit House Model, with floor area of 56 sqm.

In line with this, we will be having changes on your Contract Price as well. From the Total Contract Price amounting to Php 6,236,000.00, it will now be Php 5,532,357.66 (Php 703,642.34). Please see below new quotation for your account:

TCP 5,532,357.66
DP 829,853.65
LA 4,702,504.01
Payments Made: 492,700.00
DP Balance: 337,153.65
Sep-17 44,270.00
Oct-17 32,542.63
Nov-17 32,542.63
Dec-17 32,542.63
Jan-18 32,542.63
Feb-18 32,542.63
Mar-18 32,542.63
Apr-18 32,542.63
May-18 32,542.63
Jun-18 32,542.63

Monthly Amort: 39,333.63

Apologies for the inconveniences brought by these changes. Kindly confirm if this is amenable with you so we can already proceed with commencement of construction."

This is totally not acceptable and I do not want a smaller unit. Now can you please enlighten me on what are my options can be, what can I demand and what I can't?

The Project is already sold out and I think relocating us from other block/Lot is also impossible.

It is clearly not our fault. what should we do? please advise.

Hello po,

Write them a letter that you do not accept the changes. Ask them for options and propose your own. If you cannot come to an agreement, then go to HLURB for mediation.
