In March 2016 we purchased & paid for in cash the Elisia model, as this was the biggest house to be built on the estate - Camella Tanza Cavite. We picked a location next to the guard house, with the swimming pool & club house being built right outside our front door. We couldn't wait to move into our dream house & start our new lives together. We were told the house would be RFO (Ready For Occupancy) August 2016. July 2016 we asked Camella if the house would be completed on time, but we were told November 2016. I asked why they told me August & they requested proof, which was only told verbally to us in the Camella Alabang office.
I sent an email to Michelle E. Malana Sales Manager of Camella Homes in September 2016, asking when our house would be ready RFO. Her reply "end of november mam". When our home was STILL not complete by end of November & I now had proof (email from Michelle Sales Manager of Camella) Camella's reply was "Michelle is not an employee of Camella, she is a contractor!
I did some research & came across this on the internet:
PRESIDENTIAL DECREE No. 957 July 12, 1976
Title IV
PROCEDURE FOR REVOCATION OF REGISTRATION CERTIFICATE
Section 23. Non-Forfeiture of Payments. No installment payment made by a buyer in a subdivision or condominium project for the lot or unit he contracted to buy shall be forfeited in favor of the owner or developer when the buyer, after due notice to the owner or developer, desists from further payment due to the failure of the owner or developer to develop the subdivision or condominium project according to the approved plans and within the time limit for complying with the same. Such buyer may, at his option, be reimbursed the total amount paid including amortization interests but excluding delinquency interests, with interest thereon at the legal rate.
We sent the above to Camella November 2016, asking for a full refund, but we were ignored once more.
December 28th 2016 we finally received the keys to our new home, we had some sockets fitted & some missing. I asked the Camella ENG. "Where are the rest of the sockets?" & he informed us Camella do not supply. We pointed lots of mistakes (Cracks in the walls, painting needed touched up, handles missing from the bathroom windows, etc.) to which we were promised they would be rectified. (But to this day they have not). We moved in with no water connected to our house, only a hose pipe stuffed through a window so we could fill a bucket to get washed & no permanent electricity supply, only an electric cable joined to our house with the wires connected with black tape! (We have photographic evidence). 2 month later we got connected to Primewater & our Camella contract stated that the Camella ENG had to be present. No one came from Camella & no one would answer our calls. When the water was connected, it started pouring through our bedroom ceiling & damaged our brand new bed. We turned the water off & reported this to Camella. The next day Camella sent someone to our house to repair their mistake. Throughout the course of the next few month, things got worse. Camella decided to build larger models than the Elisia, which we were told back in March the Elisia was to be the biggest model. All our toilets were running constantly as they were fitted incorrectly. All our bathroom sinks were leaking, again not fitted correctly. Then when it rained, all our windows leaked in, we had water running down the walls onto the sockets. We had had enough & again returned to Camella Alabang to complain. Again we were told someone from Camella would come to our house, but they never did. December 2017 we finally got a permanat electricity supply & we found out later that the temporary electric we had been connected too from Camella was illegal & dangerous!
Today we see some Camella builders outside our home, erecting a wooden fence. Finally they are going to start the clubhouse & swimming pool. But no, Camella have decided they will not build the amenities there, they will build more houses!
Can we legally do anything about all the problems we have had? I have emails & photographic evidence for all the above?
