Good day po , tanung ko lang po sana kong legal ba yung contract na nagsasabing after 1 year bago maregularize sa trabaho? after one year din kami bago kinaltasan ng mga benefits. if invalid po yung contract pwede po ba namin habulin yung company?

Is the contract a probationary contract? or a project contract?

What do you mean benefit? is that SSS, Philhealth and Pag-ibig? if it is, they should be given at the start of your employment

No, hindi sya valid. If project employee ka hindi ka dapat ma regularize kahit after one year. If probationary employee ka, pwedeng lumagpas ng 6 months dahil sa extension pero dapat sa start palang ay lampas na sya. Pero it doesn't mean dahil hindi legal yung contract meron kang hahabulin sa companya.

i think probationary contract po sia. yep, I am talking to sss, pagibig, phic benefits. kasi after a year pa kami bago kinaltasan ng mga benefit. pwede po ba namin habulin ung company sa mga benefits na di nila hinulugan?

salamat. i mean hahabulin is kong may lapses talaga sila sa paghuhulog ng benefits. bale kasi di nila kami kinakaltasan ng benefits from the start.

yes, in terms of SSS or pag-ibig the employer will be responsible sa SSS and or pag ibig para maging current ang status nyo. Dapat ang status nyo parang nag hulog sila since the start. be prepared though na singilin nila sa inyo yung mga dapat kinaltas

opo payag naman po ako msgbigay nung dapat ikaltas kasi nghihinayang din po kasi ako dun sa 1 year na ngtrabaho ako tapos walang benefits. anu po pwede ko sabihin sa company pagka ganun?

i-question mo lang kung bakit wala kayong hulog sa SSS at pag-ibig etc. wag mo tawaging benefits at baka malito yung HR nyo

Hindi valid yun. Basta considered employee kayo dapat meron na. Are you sure employment contract yung pinirmahan nyo?

yes po sir, nka-state po dun sa contract na 1 year po ang probationary namin and pag regular na kami (after 1 year) eh dun lang daw po kami mahuhulugan ng sss etc.

ayaw nga po kaming bigyan ng employer ng copy ng contract ee. Pati po overtime walang bayad pero may kaltas pag late kami.

if wala kang copy sure ka na employment contract yan? Ang hula ko kasi baka apprenticeship agreement yan kaya wala kayong SSS. May copy ka ng payslip?

Yes po sir, wla po nkalagay na amount dun sa mga sss, pagibig at philhealth. bale po 15 months po ung di nila hinulog mula nung start ko magwork. kasi yung hr hindi din po maasikaso.

I-check mo muna kung bayad ang mga SSS mo, kasi kahit hindi nila kayo kinaltasan, baka naman sinagot na ng company yung supposed share ng empleyado.
