April of last year, nag apply po ang husband ko ng appliance loan. we took 2 gadgets sa bestbuy it was an appliance store which offers appliance loan. anyway, nakakuha kami ng 2gadgets w/o dep. we are able to pay the monthly fee..then, in september nakiusap ang mother ko sa amin that they wanted to get LCD TV. So, nag apply po kmi for 2nd loan under my husband's name. Yun po ung time na mdyo nagipit kami sa first loan however ung sa mother ko since they gave deposit (na cheke under her name)ok lng at tuloy nman po ang pagbabayad nila sa banko in cash. Then, sa kamalas malasan medyo antala rin ang pera dahil maraming pong bagay na dumating sa buhay nmin. But anyway, Ngayon, pinuntahan na kmi ng collection agent from Asialink at kinukuha ung TV ng mother ko.At first, it seems na di nila alam na kumuha kmi ng TV dhil ung gadgets lng ang sinasabi nila pro nabanggit na rin ng sister ko sa kanila so nalaman na nila. then, they keep on txting and threatens us to pay or else they will get the merchandise. And accusing us na talbog ang cheke ni Mother. We get some records from the bank showing we were able to pay the dep. they said wla daw kming maipakitang resibo which is true kc di nag issue ung mngr dati ng bestbuy but I believe the bank statement and the check itself showing as proof. The agents insisted that we need to get in touch with the former mngr., to get affidavit. paano nmin gagawin un eh wla na nga po sya dun...that's why I need an answers to my questions..ano rin po ba ang dapat nming gawin? thanks and god bless!

if the check was issued for the LCD tv, and that TV was already taken then you no longer have any obligation regarding that LCD Tv.

so the other gadgets are not being paid for?

cut communication if they keep insisting.

yes, the other gadgets are not paid but of course we will pay it soon not this time. they asked to return the gadget also to cover the balance. Dapat po ba ito? Sir, The LCD TV cost 22k if you pay in cash since it's a loan (payable into 12mos) it became 36K. My mother issued a check for dep amounted to 11,400 and was able to pay in 2mos. mag comply daw kmi nag 3mos fee+ penalty 500 monthly around 12K. They threaten us to file a case. maghanap daw kmi ng attorney to defend us. Sapilitang daw nilang kukunin ang TV. We are willing to pay the said monthly fee but not now... we ask them to give us more time until April. But they don't negotiate. I'm worried about my parents because they are old and yet they both have hypertension. We are not always around. Bec we both working at night. Dapat po ba tlagang i return ko na ang merchandise just to be free from worries? or I'll stand till the end? pls I need ur help so bad kc bka pumunta na nman po sila these days. so, I would know how to deal with these collection agents... ah, so they haven't gotten anything? not even the TV? if you give it all back, then that should be the end of it. you don't have to pay anything else but you lose whatever you paid.

if you want to tough it out, then don't give them back and negotiate for a new terms. change your numbers and ignore them if they come back.

they are using intimidation tactics to force you to hand them over. but note they are legal entitled to it, but they cannot take the law into their own hands if you refuse.

But In case, I hand over the merchandise to them. What are the documents that I need to provide? Should I make a letter instating that it's over, that we are free from any obligations...(such like that)? one more question....

i would just like to seek advice regarding po sa installment appliances. My husband got TV set worth 29k and a sala set worth 26k. That is 12 months to pay. He didin’t use credit card it is in-house lang po.nakahulog na sya ng 6 months.More or less nasa 29k pa po balance para sa sofa at tv.The problem is we transferred to another province at di na-report agad sa appliance center na lumipat kami. now di na po sya nakabayad for more than 3 months so hinanap kami at pinuntahan yong house ng parents nya dahil yon ang provincial address na binigay nya noon when he applied for the installment appliances. nakipag-usap yong mother in law ko sa kanila nakiusap na kung pwede hintayin lang yong pambayad pero yong tv na lang ang babayaran at yong sofa ibabalik.Nagagalit po sila at kung ano ano pananakot na sinabi na ipapadampot po nila sa pulis yong husband ko. We are willing po na ipahugot na yong sofa pero yong tv huhulugan pa rin namin,. ayaw daw po nila ng ganon gusto bayaran daw namin yong tv at sofa. di daw pwede na sofa lang ipahugot. at kami pa po ang mismo na magbabalik sa branch nila yong sofa. may branch naman din po sila dito sa nilipatan namin. di na po kayang hulugan yong sofa at talagang gusto namin ipahugot na yon. kaso ayaw nila na yon lang hugutin. we are willing to settle naman po yong tv pero gusto namin yong sofa kunin na lang nila kaso gusto nila both tv at sofa ibabalik plus kami pa yong maghahatid don sa kanila eh ang layo po at costly din magrent ng sasakyan na pang hatid eh may branch din namn po sila dito sa nilipatan namin. kaya please give us an advice po. kung ano ano pang pananakot yong sinabi nila.what shall we do attorney? possible po ba na kasuhan ka na nila with the balance worth 29k lang? at basta ka na lang po ba nila ipapakulong?
