Hi a friend of mine needs help po. Her salary was put on hold dahil hindi daw po authorize yung salary increase niya. She's been working dun sa company na yun for almost 4 years. Lately she was kind of promoted and transferred to the head office, sabi ng company she will have an adjustment since the minimum wage from her current place of work is way too different from manila's minimum wage. There was a recommendation from her head na she will be receiving Php 15,000/monthly from her current wage of Php 10,000/monthly. To make the story short, after 5 months of working in manila she's receiving Php 15,000/monthly nga then ayun sabi ng employer unathorized yung increase since walang sign or notification. They keep insisting na if ever may increase, it will be only Php 12, 847.80. Now the employer holds her salary and they wanted to compute the "alleged" unauthorized increase based sa difference ng Php 15,000 versus minimum wage of manila na Php 12,847.80,. They keep telling her rin po na hindi nya daw naiintindihan yung logic, oo daw po na wala siyang kasalanan pero siya daw po ang nag benefit nung sahod. She's not the one na gumagawa ng payroll, kaya wala po siya access dun.

Ano po ba dapat niyang gawin? Kasi mukhang walang balak po ang employer na irelease ang sahod nya at mga susunod pang sahod hanggat di nababawas yung difference na sinasabi nila.

1st, may pinirmahan ba siya na document na 15k na salary niya and signed ba ito ng representative ng company like HR? Kung meron, it is an authorized increase. Kung wala, the company might have an error in implementing the said increase. I do believe that it was not done in bad faith. Ask your friend to negotiate with the HR that to deduct the "additional" gradually and not hold the whole salary.

Actually sir ilang beses na niya kinausap yung admin at hr. Kaso same yung sinasabi nila na "di mo naiintindihan yung logic, wala kang kasalanan pero ikaw yung nag benefit" sa ngayon sir kung i estimate mo yung difference in 5 months aabot po ito ng 10,000 plus, which is macocover to july 16-31 (nahold na salary) and aug 1-15 (na baka ihold rin ulit, i presume) so ang gusto talaga nilang gawin e bawasin lahat until such time na nabuo na ung sinasabing difference. Sabi pa sa kanya "kahit saan ka magtanong ganun talaga"
Resigned na siya pero kinukumpleto na lang po yung 30 days turnover kaso yun nga sir ginigipit siya.

Wala rin po pala authority to deduct to. And one thing po, mahilig daw po mag antedate ang company ng memos and authority to deduct. Tipong na deduct na lahat saka ka papasign ng ATD.

if error ito no need for authority to deduct. since resigned na sya kelangan talagang ideduct na buo kasi wala ng ibang instance kung kelan ma deduct. tutuo ang sinabi nila hindi naman sinasabi ng companya na ikaw ang may kasalanan pero ikaw ang nakinabang.
take this example: nagkamali yung companya at naisama sa mga personal belongings mo ang company laptop. hindi mo naman kasalanan yun, kasalanan acrually ng warehouseman etc pero kelangan parin ibalik ito

Ano po pwede nyang gawin sir sa ngayon? Ibig sabihin po ba nun hindi nya pwede ipaglaban yun kug sakali?

Sino sir? Nasa kanila sir yung sahod niya. Ayaw irelease hanggat di daw po nababawas yung sinasabi nilang difference. Parang ang mangyayari po is sahod niya july 16-31 and aug 1-15 mahohold and kung ano po yung matira dun yun ang irerelease. Sir may laban po ba siya dun? Sa ngayon po araw araw pa rin siyang pumapasok to complete rhe 30days turnover. Iniisip sir ng friend ko if sakaling mag reklamo siya sa dole or nlrc baka magpakita ng proof memo na minimum of manila lang siya. Antedated or something. Ganun daw po kase gawain nila

Hindi naman po gusto lang ma enlighten. So i guess wala nga po siya magagawa kung ganun. Accept it and move on.

Hi may I seek you advise po...

di po kc ako nakapag confirm ng attendance a week before my salary date (sept 22, 2017). I forgot po to confirm my attendance yesterday (9/14/2017). Dahil dito I was advised by the payroll team that since nafinalize na daw nila ang report nila for September 22, 2017 cut off. Sabi yung pay ko for 1 week na di ko naconfirm yesterday will be credited na lng daw on October 6, 2017.

Is this not a violation po sa rights ko to my salary po? I have not signed any paper stating that I have to do such confirmation of attendance and if I failed to do so then I will not rcieve my salary.

check your policy kung ganyan naka sulat.

usually confirmation of attendance is to check if there is a discrepancy, but babayaran pa rin.

i.e. for this cut-off, the HR counted that you have worked for 10 days, you counted that you have worked for 13 days. If you do not confirm, the HR will pay you 10 days only and will add the correction on the next payroll date.

again, this is a sample. look into your payroll policy if this is the case. if not you have the right to complain to your employer and to DOLE.
