scenario: the house was used as collateral for borrowing a certain amount. The borrower was not able to pay the amount borrowed and the lender was to get thew house. However, the papers that as given to the lender was all falsification esp the signature were forged.

Question: can the lender still get the house even though the papers that he has were all invalid?

need you advise thanks so much

Yes the lender can still foreclose the property, unless you assail or question the mortgage contract in court and have annulled or invalidated.

thanks for the information. I have a follow up question even they don't have the original paper can they still foreclose the property. What can we do to have the property be back to us.?

Thanks in advance.

What do you mean original paper? are referring to the title or deed of mortgage? But they may forge another one and they also may declare the title as lost and might secure another.

they do not have the original title what they have is just a photocopy of the title and the signatures on the agreement were all forged. Do they have like an edge not to foreclose the their house and have it back to them
