Scenario:
My mom died last Sept. 2016 without leaving any will, My father is still alive and we are only 2 siblings. so my friend suggested us to make Extra judicial settlement of estate and other stuff so as to pay Estate tax without penalties and we did.My parents have numerous properties such as residential and agricultural in classification. We already transfered the residential properties into our names pero ang agri properties ay napending dahil sobra daw ito sa retention limit na 5 hectares accding to DAR. The total aggregate landholdings of my parents is 8.6 hectares and gusto nila hold ang sobrang 3.6. This 8.6 has is comprise of 6 properties. We're on process of selling the 3 properties with the condition na dapat ay maitransfer na muna namin sa amin names ang properties. Because of this my father waived his 1/3 share over doon sa paghahatian namin para nde sya sumombra sa 5has. Pero nde pa rin daw po pwede sabi ng DAR, kailangan daw hinde sosobra sa 5 has ang paghahatian. By the way kinasal po ang parents ko in 1960 i guess under sila ng new civil code. Lahat po ng properties declared conjugal as per payment sa bir. Here are my questions.
1. Ganun po ba talaga un? Paano po un kung un ibang properties na nabanggit ay mana din ng magulang ko sa lola ko. Di naman po syempre nya pwedeng tanggihan un.
2. Meron po bang ibang paraan na pwede namin gawin para nde kunin sa amin ang 3.6 has?
3. Meron po silang sinasabing suspended daw po kasi ang AO6 series 2016 kaya di pwedeng nde hold ang properties na sobra.
