Pwede po bang maging ground sa annulment yung sakit nya na hindi ipinaalam sa akin bago kami magpakasal. Hanggang s ikasal kami hindi nya ito sinabi. Natuklasan ko lamang po ito ng hindi inaasahang pagkakataon, dahil habang nag-uusap kami ay bigla nya nabanggit na meron pala syang hepatitis A, or C alin man dito sa dalawa. At hindi ko po alam kung nagpapagamot o naggagamot sya kase hindi sya nagoopen tungkol dito. Pero ngayun hiwalay na po kami sa loob ng 7 years.

Hepatitis A or C are considered sexually transmitted diseases, the concealment of their existence prior to the marriage constitutes fraud which can be a ground for annulment.

However, a petition for annulment is TIME BOUND, and a marriage that has a ground for annulment based on fraud may be RATIFIED BY MARITAL COHABITATION after the defrauded spouse learns about the fraudulent concealment but still stays with the other spouse.

1. How long ago did you discover that your spouse has Hepatitis A or C?

2. Did you still freely stay with your spouse after you found out about the Hepatitis?

1. Nadiskubre ko po ito nung nagkaron na kami ng anak.
2. nagsama pa din po kami pero hindi po katulad ng dati , parang nawalan na po ako ng gana na sumiping sa kanya. Nadagdagan po yung pagiging malamig ko sa kanya since hinahawakan din nya ako sa leeg. Nagkahiwalay din po kami.

YOU OBVIOUSLY STILL DID NOT ANSWER MY QUESTION. MY QUESTION REQUIRES AN ANSWER AS TO TIME - HOW MANY YEARS AGO. YOU CAN FILE A PETITION FOR ANNULMENT ONLY WITHIN 5 YEARS OF DISCOVERING THE FRAUD.

ALSO, EVEN IF YOU FILED YOUR PETITION FOR ANNULMENT WITHIN THE GIVEN TIME PERIOD, IF YOU COHABITED WITH HIM AFTER DISCOVERING THE FACT OF HIS ILLNESS, YOU LOSE YOUR RIGHT TO FILE THE PETITION. The legal term for this is estoppel.

It's too late. You cannot file a petition for annulment of marriage based on fraud because the action has: 1. PRESCRIBED; and 2. YOUR MARRIAGE HAS BEEN RATIFIED BY MARITAL COHABITATION.

hello mam. what if its rheumatic psoriasis? nagfifile kasinsiya ng custody for our 10mos old child. may mga times na sinusumpong siya ng sakit niya then di makalakad dahil maga ang joints and di mkanpasok sa trabho like weeks. can i use this as one of the reasons para di niya masecure work niya at pra di magamit for our case? we are not married.
