Hi po my mom was under age the time she married with her first husband she is 17 and 1to 2 months later she will turn 18 pero sa date of marriage nila kinasal sya before she turned 18 so nag continue ang nksal nila becos of parent consent ngaun po after marriage nila hndi dn naman sila nagsama parang dhil nabuntis lang ng maaga alam nyo naman po sa probinsya., so now po 37 years na sila hindi nag sasama valid po ba ung kasal even 17years old palang sya? Dahil may parental consent po ng lolo at lola ko? Sa mama ko? Kasi hndi ako malegitimate gwa ng kasal nya sa una hirap na hirap na po ako kumuha ng matinong birth certificate at passport wala padin please help! yun bang nakalagay sa certificate of marriage nila na date eh magrereflect na 17 lang yung mama mo at the time of kasal? kasi kung dun sa mga dates ng document eh pineke para palabasin na 18 sya, ano ang magiging proof nyo na minor nga sya at the time of marriage?

ah yun po ang problema. yung kasal po eh nangyari bago mag take effect ang family code. before the family code, hindi po 18 ang limit na age to marry. i think 16 sa lalake at 14 sa babae.

This means that you cannot be legitimated. Even if the first husband is dead or even if he died after your mother "married" your father, you cannot be legitimated because at the time you were born, your mother had no legal capacity to marry your father (since she was married to someone else at the time).

Your best solution would be for your mother and your father to adopt you so that your status would be raised to legitimate.

You should consult a lawyer where you are and let them prepare whatever petition is necessary.
