hi,

Good day.

i would like to ask if our marriage is valid without acquiring marriage license? we solemnized in an atty. office impromptu and we didn't give any related documents which regards to our marriage. We didn't file also in city hall for a marriage license.

but our marriage was registered in the city hall nso as part of wedding package.

i asked if i can use it as a ground for annulment?

if it can be proven that there was no basis for exemption of marriage license and no ceremony at all, then it can be grounds for annulment.

Sir,

How can i prove that there was no basis for exemption of marriage license and no ceremony at all? What documents should i look to or witnesses?

Or is my marriage void in the first place if proven? and no need for annulment?

Hi Atty,

I noticed in our marriage contract stating that "no marriage license was necessary, the marriage being solemnized under Art. .... (blank) of executive order no. (not readable). " We were not aware of this one nor it was never explaned to us.

Can the above mentioned concern valid to void our marriage?

question lng po atty.,bale wala din po kme naisubmmit na marriage license nung ng civil wedding kame,sabi kasi nung solemnizing officer cya na bahala basta ibigay lang yung kaukulang bayad then nung nakita ko na yung license from nso nakalagay nga na no marriage license presented due to art. 34..i can prove it nman atty na hindi kame ngsama ng atleast 5 yrs nung time bago yung marriage kasi almost 5 months pa lang kme nung ngkarelasyon.may basis po kaya?paano din po kung yung solemnizing officer hindi ngaappear na authorized sa nso solemnizing officers website?i did have the chance na itanong dun sa ngkasal samin,ang sabi nya naman iba yung surname nya now kc wala pa cya asawa nung time na yun pro when i checked yung name nya dapat yung magiging middle initial nya e yung surname nya last time na nakalagay pero iba po bale.ano pa po ba pwede gawin para mas macheck kung yung ngsolemnized ng marriage nmin is authorized?thanks po..

follow up question lang po.if possible nga po na maannul yung marriage,mas mura po ba yung gagastusin unlike pag psychological incapacity yung ground?

yes, that can be a ground. and yes, based on my experience it can be less expensive
