After first marriage was annulled, is the second marriage automatically valid?

I was not aware that in 1999 he married his then gf, they part ways, we met and got married in 2002 sa City Hall. Then in 2005 nagpakasal ulit kami sa simbahan naman po. 2 nga po ang marriage cert namin sa NS0 2002 and 2005.

1st marriage was in 1999 and was annulled only last year (2011).

Ang sabi po ng nakausap ko sa NSO, automatically valid na daw po yung 2002 marriage after ma-annull nung kanila ng ex nya. I am confused po. Kasi in the first place yung kasal namin is ab initio. At di po ba null and void kasi under bigamous relationship po yun? we are still together, at gusto po naming maclarify ang status namin since annulled na yung kasal nya noon 1999. My mind refuse to accept yung sabi ng taga NSO na valid na yung kasal namin nun 2002. Do we still need a court to decide the validity of our marriage? or tama po yung sabi ng taga NSO. At kung tama po sila ano po ang makukuha naming katibayan na legal na po kami.

Please help po. Thanks.

The person you talked to is wrong. Annulment of the first marriage does not validate the second marriage the latter being void ab initio.

Better have your marriage judicially declared null and void, contract another marriage, and adopt your children to legitimize them.

if i may respectfully add, i agree that it remains to be void. However, under current rules, only you or your husband can file a petition to have it annulled and it remains to be presumed to be valid until it is declared by a court as void.

as for your husband, unfortunately he committed bigamy.

i am working overseas and the only way to bring him over is that we have to be legally married, ibig po bang sabihin kung hindi kami mag fa file ng annullment "it remains to be presumed to be valid until it is declared by a court as void." pa ki explain naman po
