Good day po ask lang po ako ng legal advice kasi nagresign po ako sa work ko at nag bigay din po ako ng 30 month notice at tinapos ko po lahat ng pending sa work ko ang problems po ayaw nila bgay sakin ang back pay ko at ayaw nila pirmahan clearance ko kasi yung office mate ko na nag resign din Hindi nag turnover ng maayos at marami din sayang pending at ang gusto ng HR na ako daw mag tapos ng pending niya at ako mag turnover ng trabaho nya ang kaso mag kaiba kami ng job description pareho lang kami ng department and nasa ibang bansa na ako ngayon thank you po. Almost 4 years po ako nag work dun at nag pass ako ng resignation January 2017 last working day ko March 17 2017

Email your employer demanding for your last salary, explaining why they have no reason to hold your pay and say that you will complain if they refuse to release the same to your duly authorized representative if you are not in the Philippines. They might require you to sign an SPA though.


Won't you be able to return to the Philippines to file a complaint?

HI po panu ba mag compute ng backpay kasi I worked with my previous employer for 2 years and some months tapos ang back pay 2854.php.

Days actually worked + Incentives (if any) + Convertible Leaves (if any) + pro-rated 13th mo pay + tax refunds (if any) - Accountabilities (if any) = BACKPAY

good day po, ask ko lang po kung ano gagawin. nagresign po ako nung may 12 tapos ngayon nandito na po ako sa abroad. nag follow up po ako sa previous company ko re back pay. sabi nila since wala ako sa Pinas kelangan ko pirmahan muna yun quit claim bago nila irelease yun check ko sa representative ko. may pinadala sila na quit claim document kaso blank yun details. tinanong ko kung magkano yun amount na makukuha ko para ako na lang magsulat along with my name, address, etc. kaso ang sabi nila fill out ko na lang daw yun form plus signature tapos sila na lang daw magsulat ng amount. ano po pwede ko gawin? kasi sabi ko hintayin ko muna sabihin nila sa akin yun amount bago ko ibalik yun form kaso sabi nila sila na lang daw mag fill out.

Hi po, nag awol po ako sa company, almost a year na nagkasakit po kc as ko at d nako naka report, pwede pa po ba ko mag balik at magpa clearance? Salamat po I need po your legal advised

Lahat ng empleyado ay may karapatang magpa-clearance at walang karapatan ang employer na tutulan ang mga empleyadong kung nais nilang magpa-clearance.

Uulitin natin, lahat ng empleyado ay may karapatang kumuha ng backpay kahit nag-AWOL pa sya o hindi.

Within 3 years from the date of separation, the employee can still claim backpay.
