Good day Sir! Meron lang po ako ikokonsulta.
Nagtatrabaho po ako sa isang food manufacturing company for almost 8 years. Buwan buwan po nakakatanggap po ako ng incentive bukod po un sa basic salary. Ibinabase po ang incentive sa dami ng produktong nagawa namin n lampas po sa aming quota. Pero ngayong buwan po na ito idineklara po ng boss namin na nkahold ang incentive namin dahil bumaba ang quality index namin. Legal po ba ang ginawa nya?
wla naman po pagbabago sa quality index namin. nagulat po kming lahat kung bakit naging isyu un. ang sabi po sa amin ibibigay lang ung incentive ulit kapag naayos n quality index, e simula't simula po ganun na yun..

Pangalawa po. Pag nagkakaroon ng umento sa sahod, hindi po binibigay sa amin ung buong halaga ng umento.. halimbawa po, 20pesos po ung umento ayon sa mandato ng gobyerno, 10pesos lang po ang binibigay sa amin. May Violation po ba dun? Nung magdagdag po ng 10peso cola ang gobyerno, idinagdag po sa basic salary namin ung Cola kaya lalong tumaas po ang tax deduction namin. Sana po tulungan nyo po maliwanagan ang isip ko. Hindi po ako masyado maalam sa batas.

at ang panghuli po. pag nagresign po ako, ang mkukuha ko lang po ay ang 13th month pay tsaka ung last na sahod.. balewala po khit 8years n ako nagtatrabaho sa kumpanya..

Unless your company has an approved retirement plan in place, there is no separation pay that can be given.

Art. 287 of the Labor Code (dealing with Retirement) says:

In the absence of a retirement plan or agreement providing for retirement benefits of employees in the establishment, an employee upon reaching the age of sixty (60) years or more, but not beyond sixty-five (65) years which is hereby declared the compulsory retirement age, who has served at least five (5) years in the said establishment, may retire and shall be entitled to retirement pay equivalent to at least one-half (1/2) month salary for every year of service, a fraction of at least six (6) months being considered as one whole year.

tungkol naman po dun sa umento sa sahod na itinakda ng gobyerno, may karapatan po ba ang company na bawasan or kalahati lang ang ibigay na dagdag-sahod?
