Hi,

I would like to ask if I may insist to my previous employer to provide an explanation how did one of my biometrics logs went missing and then after two months, it then appeared on our attendance portal?

My previous company have a policy of whole day deduction and AWOL if both no login and logout of the same day while half day deduction if no login or logout within the day. I am not discounting the possibility that there were other instances that I had committed no login/no logout. And I accepted the consequences at first. But when it was occurring for several number of times already, I then started to doubt if it is really that I was the one that forgot. I reviewed then the biometrics reports to my HR and then I just realized that there should be an analysis why one of my biometrics logs went missing and then came back after two months. When I asked our HR and the inhouse developers that build our system, they could not answer me straight. I am in doubt then that our biometrics logs has been manipulated. The day that I was asking for analysis was covered by the time that the biometrics system is on beta testing period. When I asked if I could have a copy of the manual logs, they say they would give it after two weeks, then the time they gave lapsed they still did not give me the manual logs, then I follow up again but then I was ignored. When I resigned, they say they agreed to provide me the manual logs after a month, but after waiting for it, still they did not provide it.

When I file disputes when I am still with them, they require me to provide them screenshots that I really logged in / out. Considering that my previous company has a CCTV and an IT company as well, I do think that requirement is not valid considering that there are many other ways to prove my attendance such as email, internet browsing logs, server logs, Code versioning commit logs, other team member's concurrence of my attendance, and then ultimately rechecking of CCTV.

It was one of the cause of my resignation as it made me doubt that they are manipulating the biometrics. I had not signed yet my quit claim for several months already because of their inaction. i told them that it is a form of dimunition of salary as they are not open on investigating if it is really the employee's fault on not having biometrics records.

Thanks for the reply. The significance of the amount is a subjective matter and I as an employee that had opted not to claim yet his separation pay because of those cases is a proof that this really matters to me. Nag self investigate na ako about dun sa nirereklamo kong araw. Nag self investigate na ako kung paanong paraan malaman kung ndi na mamanipulate yung db ng biometrics. Tinanong ko yung developer kung may chance ba na nabura at kung paanong paraan bumalik yung entry ko sa biometrics? Tinanong ko kung may paraan ba para malaman kung kelan ipinasok sa db yung entry from biometrics? Sabi sakin ndi nila nalagyan ng column sa db table kung kelan. Tapos tinanong ko kung may auto increment primary keys yung table sa db, bigla naman sabi sakin na ndi siya nagbubura tapos walang primary keys yung table. Ha? sa isip ko programmer din ako, papaanong walang primary key ang isang database table used for dtr. It is a common standard for database management, and yung columns for when it was inserted, it is a standard for auditing db. at Nung tinanong ko sa email kung sunod-sunod ba yung mga time ng ibat ibang empleyado na ipinasok sa db, ayaw na niya ako sagutin. Ndi na nila ako sinasagot ng direkta. May hinala kasi ako na nabully ako nung araw na iyon na inirereklamo kong bigla na lang bumalik at meron akong nakikitang dahilan kaya ginawa nila sakin iyon. Binully ako ng isa o higit pa sa isa sa may mga alam ng credentials ng db ng biometrics kasi tinanong ko sa timekeeper if may iba pa bang reported case na katulad nung sakin nung araw na iyon, sabi niya wala naman at ako lang. At yung mga iba pang araw na namarkahan ako na no login / no logout n ndi na bumalik sa db, gusto ko malaman kung totoo ba talaga na ako ang nakalimot. Yung ibang mga araw na nirereklamo ko ay sakop na ng strict implementation ng no bio/no pay nila at ndi na sila nagpapa manual logs. Nagkataon pa na yung isang araw na iyon ay pinapag overtime kami ng restday na nag result ng half day non payment of OT.

Ang kaibahan lang ay naka tatlong taon ako sa dati kong kompanya at ang habol ko ay constructive dismissal and moral damages claims.

Sa amin ay kapag walang magkapares na login at logout at ndi nag overnight OT nung nakaraang araw eh automatic half day rin.
Tinanggap ko na ito ay company's prerogative pero yung maging kaduda duda yung system, at ndi sila open sa investigation, kareklareklamo na. Nagkaroon pa ng mga other side issues dahil dito gawa ng yung visor ko ay nireport ako sa HR na may mga previous instances ako na no lead time under time / VL. Pero nung tinatanong ko kung kelan yun at nabanggit ko sa visor din niya na hinahanap ko kung kelan yun at nakakapag take ng time sa trabaho ko ang paghanap dun, nagbigay siya ng threat na magbibigay siya ng memo of insubordination sakin.

Nung nagka no logout entry uli ako na nakapagtataka na na warningan na ko before at naging maingat na ako magmula nun, nag request ako kung maaring icharge na lang sa SL credits ko. Nagkataon kasi na may sportsfest training kami nuon. Nung una, denied yung request ko to not apply deduction. Kaya tinanong ko kung makapagpakita ako ng medical certificate concerning my memory loss, ay pagbibigyan na nila ako. Sa kalagitnaan, nagdagdag sila ng amendment na manual attendance sheet na lang kapag may sportsfest training. Pero nagrequest pa rin ako na ireview yung case ko at kung pde ma convert as SL na lang yung mga no login / out. Tinuloy kong magpa consulta sa doctor. wala naman nakitang kung ano man sa EEG habang nagdefer ako sa CT scan. Kaya naliwanagan na ko na indi dementia at an early stage for a 28 yr old yung case ko kundi stress related out of focusness. Binanggit ko yun sa kanila at pinaalam ko rin na magkaminsan ay delayed kung magpakita sa attendance portal yung login / logout entry namin. Kapag napapapansin ko yun nung una, pinapagpaliban ko munang ireport kasi mag si sync rin yun, icheck ko na lang sa sunod uli. Kaya tuloy ndi na malaman kung tunay nga na nakalimot mag punch in / out dahil sa instances na mga ganon. Tinanong ko rin yung dev kung gaano katagal dapat before matransfer to db of attendance portal yung logs, ang banggit niya ay kada minuto mag check yung may kailangan isync. At dun ko rin nalaman na kapag offline yung biometrics, ma dedelay yung pag sync hanggang sa mag online uli ito.

Kung totoo nga na mag sync lang uli pagka online nung biometrics to attendance portal server, papaanong nangyari na yung isang nawala kong araw na nakakapagtakang tinag ako as AWOL at umabot ng payroll processing matapos ng isang buwan, nakaltasan ako nung dumating yung payday at pagkatapos ng isang buwan pa uli ay bumalik na lang bigla sa attendance logs? Paulit ulit na sumasagi sa isip ko kung paano nangyari yon na nakaapekto na sa pagtatrabaho ko sa kanila. Nagrequest na ako sa mga HR at inhouse devs na ipaalam naman sana nila kung meron silang mga ginagawa sa system. Kaya ang ginagawa ko na lang pagka login / logout ko ay bumabalik ako sa computer workstation ko para icheck kung pumasok yung logs. Nung nagkaroon uli ng pagkakataon na yon, natanong ko na sa dev kung may paraan ba na malaman kung offline yung biometrics, nun lang niya nabanggit sa akin at nung chineck ko yung memo announcing yung strict use of biometrics, napansin ko na makakatulong kung iannounce nila sa buong office kung paano malaman kung offline yung biometrics. Nirequest kong ipagbigay alam nila iyon sa lahat. Pero ang HR, nagsabi na optional lang ipaalam yon kasi mag si sync rin naman. At yung binabanggit ko na bigla na lang bumalik na araw sa logs ko ay dahil nasa testing stage pa naman yung biometrics at naibalik naman sa akin yung kinaltas. malamang sa tinagal ng paggamit namin ng isang taon eh nagawan na ng paraan ng devs na ndi na nangyayari iyon. Kaya gusto ko rin sana makuha yung manual logs para malaman kung yung bang bumalik na logs sa portal eh kaparehas nung sa manual.

Ang tanong lang eh bakit ndi nila ibigay kung anong nangyari at paano nila niresolve yung nawala at bumalik na bio logs ko? I am as well a developer at kapag nakaka encounter ako ng mga ganyang scenario, I am keen on looking into the root cause of the issue. Hindi tama na pinapalagpas lang yung mga pagkakataon na ganoon. I am also aware that a system have some confidential algorithms that needs to be shared to authorized persons only pero yung bang tinatanong ko ay mai-categorized ba as confidential? Information and Job Security kasi ang tinatanong ko dito at totally at a disadvantage ang mga empleyado sa mga may alam ng credentials ng database ng attendance portal namin considering na inhouse ang pagkagawa nung software ng portal namin. Dapat restricted ang may alam ng delete and update privilege.

Nireview ko via chat at emails yung araw na nawala at bumalik at may nakita akong  possible reason kung bakit nila ako binully.

sorry for too much explanation.

Gist of it is that I am complaining as my previous company have a no bio/no pay policy but they could manipulate the database. And I have investigated that they could have done those alteration as a form of bullying. There are then several other attendance record issues that crop up which are unfounded and was retracted. My wife had already consulted about my case to DOLE and they say that I may file harassment case. Question is, where would I file? to NLRC, brgy, or on DOLE?
