Good evening

I would like to kindly request for your advice regarding this case,

nagwork po ako sa company na ito, way back 3 months ago, syempre dahil bago ako at di ako na orient at na train, first day palang sabak agad ako sa work, kaya naman di ko rin na perfect agad ang work ko, meaning marami akong lapses and it lead to my pre-termination of contract.

I accepted their decisions if they will not render me regular, and eto awa ng Dios natanggap ako sa isang company na mas malaki ang offer na sahod.

eto po kasi ang nangyari dyan:

Di ko kasundo yung admin sa office na syang may hawak ng biometrics, there are times na kahit nakapag biometrics ako, kapag nag claim silang umabsent ako, the office will question my attendance, and buti nalang may record din ang guard para ma justify ko ang attendance.
and most of all may CCTV to confirm that i was really there.


maraming times ko tiniis ang mga kabastusan at kawalan ng modo ng mga taong yan, mga pag P.I saken ng mga manager, that i knew they had no right na mag PI saken especially kapag petty mistakes lang ang nagagawa ko.. anyway so much for the sentiments

then to continue eto na nga po, it was nung june 30 to July 14 i reported to office, yung ipinasok ko ng june 30 to july 14, makukuha ko ang sahod nun sa July 25.

Then i admit sa sobrang pagkainis ko na sa kanila, at sinabihan na rin ako ng boss ko na di ako mareregular, i started to be AWOL from July 15 until now. i spent the time in finding a new job, and thank God nakahanap ako ng bagong work na mas malaking sahod...

then nung july 25 nga hinold nila yung sahod ko, at dahil di raw kumpleto yung mga in and out ko sa biometric at di ko nasettle i-file...

and upon asking sa accounting ang mga dates na yun, nagulat po tlg ako dahil pumasok ng mga days na yun na sinasabi nilang wala akong out at in.

I asked advice from DOLE lawyer personally, he told me to settle all my liabilities with them, then kapag hinold pa nila ang sahod ko saka ko daw sya balikan

Now i am to ask this thing:

1) i suspect ginalaw intentionally ng admin ang biometrics ko, and they instructed the guard na i-refuse ako kapag nagrequest ako ng records ng in and out... if ever ba na ma prove ko yun? pwede ko ba sya i complain?

2) yung pagkaka-AWOL ko ng July 25 until now? pwede ko ba syang i file as "Constructive dismissal" kasi sabi ng DOLE kapag di ko n daw nakayanan ang sobrang hostile working environment at bigla akong nawala pwede daw yun..... i am just asking? ang constructive dismisall po ba ay pina-file ng employee o ibinibigay ng employer?

1. very hard to prove unless meron kang witness na mag sabi na inutusan syang baguhin ang records. or maybe a computer expert na magsabi na tampered yung records. but if ma prove mo yes you can file a complaint.

2. constructive dismissal - ibig sabihin ginawan ng situation ng company para mapilitan kang mag resign or humiwalay sa companya

Hi! I really need to get some advice with my case here. I worked in a pioneer or newly opened account which is an outbound sales. They have no sss, philhealth or tax deduction or business permit. The contract i signed with them is dated july 5th 2016 to 2017. I started july 5th and got terminated august 4th due to 3 absences. First two absences were valid because my daughter was hospitalized and the 3rd one is not but they didnt ask for any medical certificate but they made me sign written warning. Bottom line is after being terminated I was told that there is a 20k training bond and they declined to pay the days i worked for which is 7 days. I talked to them nicely but still they said they can pay my 7 days in return i gotta pay them the 20k training bond. What do i do? 😢😢😢
