Hi Sir/Madam, I am currently married but separated (not legally yet). We have a 4 year old daughter. What are my rights and what can I do to get weekend access with my child? I pay regular child support. I want to be able to spend time with my daughter on weekends with my family but my ex-wife will not let me take her, and the reason for this is she does not want our daughter to meet my new family. Does my ex-wife have the right to do that? What steps can I do legally to get my access to my child? Please advice.

Hi,

You and your wife have joint parental custody and authority over your daughter. This means, you and your wife have equal rights to be with you child. If she refuses to let you be with your daughter and you are living in the same barangay or different but adjacent barangays, then you may seek the assistance of the barangay officials. If not, your option is to file a petition in court to assert your right to joint custody over your daughter.

Katrina, thank you for the reply. How long will it take if I filed for petition in court to assert my right to joint custody and how much? Can you refer me with an attorney who specializes with this if it's not yourself? Can you be so kind and give me contact? Thank you in advanced.

This proceedings may take 1-2 years, unless you and your wife decides to amicable settle the case and come up with a child custody agreement (with the assistance of your lawyers) after a few hearings in court.
