Hi.

Good Evening.

I just want to ask about the legality of extending the probationary period.I was hired last July 11, 2016 and to be regularize this coming January 11, 2016

Currently i was working as a MIS Administrator and directly reporting to the President/CEO of the company for about 5 months now but a organizational re-structure occur. they asked me to report directly to the accounting head verbally, now the time of my regularization that needs a evaluation about my performance the accounting head ask our HR dept that my probationary period needs to be extended for 3 months cause she only knows me about a month. and our HR ask me to report again to work this coming january 16 so my 3 months extended prob will start.

My question is is this legal? cause my argument is since the president/CEO still working in the company that knows my performance they should talk about that evaluation but instead they ask for another 3 months extention.

Yes it is legal. Look at it this way, as of now the company feels that it has insufficient data to grant you regular status and if push comes to shove they would rather not hire you on a regular basis. They are giving you another 3 months to prove your worth. If you agree then probationary period will be extended. If not then you will be terminated.

The supreme court has ruled on the validity of such extensions.
