I've been six months and four days now in my job and supposed to be in the contract that I signed, prior to the expiration of my probationary employment my performance shall be evaluated but up to now there's no evaluation happening.
Under my contract it states there that I will be evaluated by my immediate superior which is the Executive Chef or the head chef but suddenly hr told me that the Hotel Manager will be the one to do the evaluation because he asked for it.
I don't have a good camaraderie with my Hotel manager and I know the reason why he wants to do my evaluation is just to fail me so that I will not qualified for regularization.Is he allow to do my evaluation?If that's happened and he fail me can I file a complain against my employer? and what legal action I will take.
