Hi,

Sana po matulungan niyo ako. Tinapos ko po yung contract ko sa employee ko ng maaga although technically hindi pa naman ako nagtatrabaho sa kanila pero may contract kami na pinirmahan na they will sponsor all of our expenses to take a certain exam sa profession namin, pag pumasa na po kami ay pwede na kami magtrabaho sa ibang bansa. Then part ng contract na yun is a penalty fee of 25% of the total expenses nila samin.

Nais ko pong malaman ang mga sumusunod:

1. Legal po ba ang penalty sa ganitong uri ng mga kontrata?
2. Kung legal po, may paraan po ba na ma-waive iyon? Willing naman po akong bayaran ang lahat ng ginastos nila pero masyado pong mabigat ang additional 25% na hinihingi ng company

Ang company po na yan ay agency na nag aassist samin na makapag exam at para makapagtrabaho sa US. Pero dahil sa hindi nila ako mapaalis ng bansa as soon as possible, humanap po ako ng ibang kompanya na kaya akong suportahan na makaalis agad.

yes legal yan unless you petition the court to nullify it. pwede yan i waive if papayag yung agency. if masyadong mabigat yung 25% bakit ka pumayag dito? hindi ba ito ipinaalam sayo?
